VACANCIES, PROMOTIONS AND TRANSFERS. A. Whenever a teacher is interested in being considered for assignment to any professional position in the district, he/she shall file written notice of his/her interest to the Assistant Superintendent of Human Resources. The Board declares its intention to give full consideration to present staff members in all vacancies in which they have expressed an interest.
1. It is agreed that any vacancy occurring during the current school year shall only be filled on a temporary basis for the remainder of that school year. By May 1 of each year, a list of all vacancies shall be posted in a designated area in each administrative unit. Any teacher with proper qualifications may, within seven (7) calendar days of May 1 and all subsequent postings until August 1 of each year, apply for and shall be granted an interview before such vacancy is filled, with the exception of when reductions in grade levels/subject areas occur in a building allowing first right of refusal to displaced staff for any open positions in his/her individual building. Vacant positions will be posted for three (3) work days after August 1 and prior to the first reported student instructional day of each year.
2. Any teacher requesting transfer between administrative units shall notify the Assistant Superintendent of Human Resources by April 30 for transfer in the subsequent year. Involuntary transfers within a building will occur prior to extending consideration to voluntary transfer requests. Before vacancies are filled, the qualifications of each teacher who has requested transfer shall be reviewed.
3. It is agreed that any teacher making written request to be assigned a position whose FTE is less than their current assignment has no guarantee of a future increase in FTE except as provided by the process defined elsewhere in this Article.
4. A vacancy shall be defined for purposes of this contract as a position presently unfilled, one to be open in the future or a new position, and which has no teacher on leave of absence or layoff status with the claim to the position.
B. Since the frequent transfer of teachers from one school and/or grade level to another is disruptive to the educational process and interferes with optimum teacher performance, the parties agree that unrequested transfers of teachers are to be minimized.
VACANCIES, PROMOTIONS AND TRANSFERS. A. A "vacancy" shall be defined as any position within the bargaining unit either newly created or a present position that is not filled.
B. A vacancy within the bargaining unit to be filled shall be posted within seven (7) calendar days from the date of vacancy and the employees shall be given five (5) working days time in which to make application to fill the vacancy or new position. A vacant bus run shall also be posted as provided in this paragraph and shall be awarded at a meeting as provided in Article X, B. 1 .
C. If a vacancy occurs while there are employees on layoff, the position shall be posted and those on layoff shall be notified of such vacancy by certified mail. The employee shall keep the Administration office appraised of his/her latest address.
D. The Board shall have the right to fill the vacancy temporarily until a transfer or promotion of an employee has been completed. This employee shall receive the pay rate of the vacancy or his/her present pay rate, whichever is higher.
E. The following format will be used to advertise vacant positions:
1. Type of work
2. Starting date
3. Rate of pay
4. Hours to be worked
5. Classification
F. When a vacancy occurs, it shall be awarded to the most senior applicant from within the bargaining unit who possesses the necessary skills and physical requirements for that specific job classification; provided, however, that a vacancy in the mechanic classification may be awarded to the applicant, internal or external, who the Board, in its sole discretion, determines is best qualified for the position. If an employee is currently working in the classification, or has worked in the classification for the District, he/she shall automatically be considered to possess the necessary skills. To possess physical requirements the employee must be physically able to perform the work.
G. Failure to follow this Article shall be subject to the grievance procedure. However, award of a higher-rated classification based on necessary skills and physical requirements may be processed only through Level III of the grievance procedure.
H. The parties agree that un-requested transfers are to be minimized and avoided whenever possible. In making voluntary transfers the wishes of the individual will be considered to the extent that these considerations do not conflict with the best interests of the school system.
VACANCIES, PROMOTIONS AND TRANSFERS. A. The Board recognizes that it is desirable in making assignments to consider the interests and aspirations of its teachers. Requests by a teacher for a transfer to a different class, building, or position shall be made in writing, one copy of which shall be filed with the Superintendent. Such requests shall be renewed once each year to assure active consideration by the Board. The Board will give serious consideration to such requests.
B. Whenever a vacancy in any professionally certified position in the school system shall occur, the Board shall publicize the same by giving notice of such vacancy to the Association and posting a notice in each school building for at least ten (l0) calendar days. Additionally, notices shall be e-mailed to current staff’s school e-mail address both during the school year and the summer recess.
C. Any teacher may apply for any such newly created position, vacancy or promotional opportunity. The application shall be in writing and shall be filed with the Superintendent's Office within ten (l0) days after the list has been forwarded as provided in Paragraph B. above. All applicants who are certified for the position will be interviewed. Applicants not selected for the position will be given feedback regarding the decision. In filling such positions the Board agrees to give due weight to the professional background and attainments of all applicants. The Board's basic consideration in filling vacancies, new positions and making promotions will be in the best interest of the school system. Consistent with this basic consideration, the Board will follow a policy of filling new positions and making promotions from within its own teaching staff when this applicant is the most qualified. An applicant’s seniority shall be given serious consideration. The decision of the Board is final when it involves a position outside the bargaining unit. Transfer requests for vacancies that occur between July 1st and the start of the school year shall be made to the Personnel Office in writing by July 1st. Vacancies that occur between July 1st and the beginning of school may be filled immediately either by transfer or by a new hire, and the ten (l0) day period set forth herein is hereby waived for this period. When an elimination of a position occurs (e.g., a particular building is reducing from three 2nd grade teachers to two 2nd grade teachers), the teacher with the lowest district- wide seniority of teachers in that grade level would be placed...
VACANCIES, PROMOTIONS AND TRANSFERS. A. Posting Vacancies Vacancies (a position which cannot be filled from within a building) will be posted for a minimum of seven (7) days before the position is filled permanently. Vacancies will also be listed on the district’s website and a hard copy should be sent to the association president. Whenever a teacher is interested in being considered for assignment to any vacancy in any professional position in the District, he/she may file written notice with the Superintendent of Schools or his/her designee prior to the deadline stated on the posting. Before any such vacancy is filled, the qualifications of each teacher who has filed a notice of interest shall be reviewed. Consistent with the parties’ basic purpose of providing a quality education for the children of the District, such vacancies shall be filled by the Board with the best-qualified person available in the judgment of the Board. The top 3 seniored and highly qualified teachers that express, in writing, their interest in the vacancy will be interviewed prior to interviews conducted with outside applicants. If an employee is denied the position, he/she will have the right, upon request to the Assistant Superintendent of Human Resources, or his/her designee, to hold a meeting for the purpose of receiving in writing a statement with the reason for denial of said position.
VACANCIES, PROMOTIONS AND TRANSFERS. A. Vacancies occurring within the bargaining unit including newly created positions shall be posted on a designated bulletin board in each building. Positions as above described should be posted ten (10) calendar days prior to being filled on a permanent basis. Teachers may apply for such positions by submitting a written application to the Personnel Office. When experience and qualifications and performance evaluations are substantially equal, preference may be given to employees currently employed by the Board and in line with their seniority. The district's failure to post such vacancies shall not prevent the district from filling any positions.
B. Summer vacancies should be posted ten (10) calendar days, prior to being filled on a permanent basis, on a bulletin board in the Administration office. A copy of said vacancies will be sent to the local Association President or his/her designee.
C. If a currently employed staff member applies for a vacancy but is not selected she/he may within seven (7) days request in writing the reasons she/he was not selected. The request will be answered in writing within a reasonable period of time.
D. The Superintendent or his/her designee shall notify in writing the affected teacher of the reasons for an involuntary transfer.
E. All certified personnel in the New Xxxxxxx School District shall be given full credit for time spent as a teacher in the district under the terms of this Agreement.
F. The Board may make all transfers of teachers which it deems necessary, provided: 1. Written notice of transfer is to be given to the teacher or teachers affected.
VACANCIES, PROMOTIONS AND TRANSFERS. Whenever any vacancy in the bargaining unit shall occur, the Board shall publicize the same by giving written notice of such vacancy to the Association and providing for appropriate posting. As positions become available during the summer, the Association shall be notified by mail (certified or registered) of the existence of such openings.
VACANCIES, PROMOTIONS AND TRANSFERS. 10.1 The term VACANCY as used in this agreement, shall mean an unfilled position.
10.1.1 Except in the case of an emergency as determined by the SUPERINTENDENT, notices shall be posted on the District's official website for a period of seven (7) calendar days prior to the filling of a vacancy. The UNION shall be notified whenever an emergency is declared. Vacancies which are to be filled as a result of an EMPLOYEE's returning from leave, placement of involuntary transfers, and staff reductions will not be posted. Summer employment vacancies shall be posted on EMPLOYEE bulletin boards.
10.1.2 Any current EMPLOYEE interested in applying for any posted position may apply for the position with the appropriate listed vacancy contact.
10.1.3 If two applicants for a position are considered to have equal qualifications for a particular position as determined by the SUPERINTENDENT, and if a current EMPLOYEE is one of those applicants, the current EMPLOYEE shall be given preference for the position. Current EMPLOYEEs who are not selected to fill a position for which they have applied shall be notified.
10.1.4 If two or more applicants for a position are considered to have equal qualifications for the position, as determined by the SUPERINTENDENT, and if the applicants are current EMPLOYEEs, the most senior EMPLOYEE shall be given preference for the position.
10.1.5 When filling temporary positions, the Superintendent will give equal consideration to all interested and qualified employees within the site.
VACANCIES, PROMOTIONS AND TRANSFERS. A. Any teacher who is transferred to a supervisory or executive position and later returns to teacher status shall be entitled to retain such rights as he/she may have had under this Agreement with full credit for all service in the district should a position be available for which he/she is fully qualified and fully certified to teach.
VACANCIES, PROMOTIONS AND TRANSFERS. A. Teacher Request for Reassignment. The Board recognizes that it is desirable in making assignments to consider the interests and aspirations of its teachers. Requests by a teacher to change his/her teaching assignment shall be made in writing, one (1) copy of which shall be filed with the Superintendent and one (1) copy shall be filed with the Association. The application shall be made annually before April 1. If a teacher is denied a transfer for which he/she has applied, the teacher shall be entitled to a conference with the Superintendent, who shall give the reasons for the denial.
B. Definition, Temporary Vacancies, and Posting
