Common use of Jurisdiction of Arbitrator Clause in Contracts

Jurisdiction of Arbitrator. The Arbitrator shall be without power or authority to add to, subtract from, or alter any of the terms of this Agreement or award damages. (Make whole remedies, including interest, shall not be considered damages.) The Arbitrator shall be without power or authority to make any decision which requires the commission of an act prohibited by law. The Arbitrator shall have no power or authority to rule on any of the following: a) Failure to re-employ any provisional employee. b) The termination of services or failure to re-employ an employee to a position on a supplemental contract. c) Any matter involving employee evaluation, provided the re-evaluation procedure shall be subject to the Arbitrator’s review.
