Common use of LABELING AND SAFETY INFORMATION Clause in Contracts

LABELING AND SAFETY INFORMATION. Buyer is solely responsible for ensuring compliance with all labeling, marking, safety data sheet (“SDS”), and informational requirements with respect to Products and Raw Materials (collectively, “Informational Obligations”)—including, but not limited to, those imposed by the Hazard Communication Standard (29 CFR § 1910.1200), the Workplace Hazardous Materials Information System Regulation (Ontario), and California’s Proposition 65—and shall instruct Seller as to the same. Although Seller may provide advice, feedback, and information to Buyer with respect to Informational Obligations, such advice, feedback, and information does not alleviate Buyer from its obligations under this paragraph. SELLER PROVIDES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO ANY SUCH ADVICE AND DISCLAIMS ANY AND ALL LIABILITY THAT MAY ARISE FROM BUYER’S USE OF OR RELIANCE ON SUCH ADVICE. Xxxxx is responsible for consulting with legal and regulatory advisors as needed in order to comply with the law and satisfy its obligations under this paragraph and these T&Cs.
