Labor and Personnel. At all times, Contractor shall utilize approved, qualified personnel necessary under this Contract. Contractor agrees not to subcontract any portion of this Contract without the prior written permission of UConn Health. Contractor shall advise UConn Health promptly, in writing, of any actual or anticipated labor dispute or other labor-related occurrence known to Contractor involving Contractor’s employees or subcontractors, which may reasonably be expected to affect Contractor’s obligations under this Contract. UConn Health shall then have the option to require Contractor to arrange for temporary employees or subcontractors satisfactory to UConn Health to provide Goods and/or perform Services otherwise to be delivered or performed by Contractor hereunder. Contractor shall assume full financial responsibility for any economic harm caused to UConn Health by such subcontract arrangement. Contractor shall be responsible for maintaining a tranquil working relationship between Contractor’s work force and any State employees or other contractors present at the work site. Contractor shall quickly resolve all labor disputes which result from Contractor’s presence at the work site, or other action under its control. Labor disputes shall not be deemed to be sufficient cause to allow Contractor to make any claim for additional compensation for cost, expenses or any other loss or damage, nor shall those disputes be deemed to be sufficient reason to relieve Contractor from any of its obligations under this Contract. Upon UConn Health’s request, Contractor shall reassign from this Contract any employee or representative whom UConn Health, in its sole discretion, determines is incompetent, dishonest or uncooperative. In requesting the reassignment of an employee under this paragraph, UConn Health shall give ten (10) Business Days’ notice to Contractor. Contractor will then have five (5) Business Days to attempt, if it so desires, to satisfy UConn Health that the employee should not be reassigned. UConn Health will then make a decision as to reassignment, in its sole discretion, which decision shall be final. Notwithstanding the foregoing, UConn Health reserves the right to require the immediate removal of any individual whom UConn Health reasonably believes, in its sole discretion, presents an immediate risk to the health, safety and/or reputation of UConn Health and its community.

Contractor will then have five (5) Business Days days to investigate the situation and attempt, if it so desires, to satisfy UConn Health UCHC that the employee should not be reassigned. UConn Health will then make a ; however, UCHC’s decision as to reassignment, in its sole discretion, which decision discretion after such five (5) day period shall be final. Notwithstanding Should UCHC still desire reassignment, then no longer than five (5) days thereafter, or ten (10) days from the foregoingdate of the notice of reassignment, UConn Health the employee shall be reassigned from this contract.
c) The foregoing notwithstanding, UCHC reserves the right to require the immediate removal of any individual whom UConn Health such employee which UCHC reasonably believes, in its sole discretion, presents represents an immediate risk to the healthhealth safety, safety and/or reputation of UConn Health UCHC and its community.

Labor and Personnel. At all times, Contractor shall utilize approved, qualified personnel and any Comptroller approved subcontractors necessary to perform the services under this ContractAgreement. Both the Contractor agrees and any and all subcontractors shall not perform any services under this contract outside of the United States. Should the Contractor or any subcontractors perform any cell center services to subcontract the state, such state business- related call center and customer service work must be performed by state contractors or other agents or subcontractors entirely within this state, except that, if any portion such contractor, other agent or subcontractor performs work outside this state and adds customer service employees who will perform work pursuant to such new contracts or agreements, such new employees shall immediately be employed within this state, in compliance with Section 31-57aa of this Contract without the prior written permission of UConn HealthConnecticut General Statutes.
