Landlord’s Fees and Costs. Tenant shall pay Landlord a fee for reviewing, scheduling, monitoring, supervising, and providing access for or in connection with the Work, in an amount equal to five percent (5%) of the total cost of the Work (including costs of plans and permits therefor), and Landlord’s out-of-pocket costs, including any costs for security, utilities, trash removal, temporary barricades, janitorial, engineering, architectural or consulting services, and other matters in connection with the Work, payable within thirty (30) days after billed.

Tenant shall pay Landlord a reasonable fee to cover Landlord’s overhead and out-of-pocket costs, including the cost of any outside engineer, architect or consultant, in reviewing Tenant’s plans and specifications and performing any supervision of Tenant’s Work, and such fees as Landlord may reasonably impose for utilities, trash removal, temporary barricades and other matters in connection with Tenant’s Work.

If Landlord acts as Tenant’s construction manager for Work under this Lease, Tenant shall pay Landlord a fee for reviewing, scheduling, monitoring, supervising, and providing access for or in connection with the Work, in an amount equal to fifteen percent (15%) of the total cost of the Work (including costs of plans and permits therefor), and Landlord’s out-of-pocket costs, including any costs for security, utilities, trash removal, temporary barricades, janitorial, engineering, architectural or consulting services, and other matters in connection with the Work, payable within ten (10) business days after billed. If Landlord is not the construction manager, the parties shall mutually agree upon the fee to be charged for Landlord’s reviewing, scheduling, monitoring, supervising, and/or providing access for or in connection with the Work, in addition to Landlord’s out-of-pocket costs, including any costs for security, utilities, trash removal, temporary barricades, janitorial, engineering, architectural or consulting services, and other matters in connection with the Work, which shall be payable within ten (10) business days after billed.
Landlord’s Fees and Costs. Notwithstanding anything to the contrary contained in the Lease, neither Landlord nor any agent or employee of Landlord (including, without limitation, any property) shall be entitled to receive any administration or other fee from Tenant in connection with the design and construction of the Additional Tenant Improvements or the supervision thereof and Landlord shall be solely responsible for all costs incurred by Landlord in connection with such administration and supervision.

Tenant shall pay Landlord: (a) a fee for reviewing, scheduling, monitoring, supervising, and providing access for or in connection with Tenant's Work, in an amount equal to five percent (5%) of the total cost of such Tenant's Work, plus (b) Landlord's reasonable out-of-pocket costs, including any costs for security, utilities, trash removal, temporary barricades, janitorial, engineering, architectural or consulting services, and other matters in connection with Tenant's Work, which payments shall be made by Tenant from time to time within thirty (30) days after billed by Landlord.

Notwithstanding the foregoing, the fifteen percent (15%) fee provided above shall be reduced to two and one-half percent (2.5%) of the total cost of the Work with respect to any Work completed within eighteen (18) months after the date hereof.

Tenant shall pay Landlord a reasonable fee for reviewing the Work, not to exceed two percent (2%) of the total cost of the Work (including costs of plans and permits therefor), but not to exceed $225,000.00 on any one project, and Landlord's out-of-pocket costs incurred to third parties, including any costs for engineering, architectural or consulting services, and other matters in connection with the Work, payable within ten (10) days after billed.
