Late Payment Provision. A Clean Claim submitted for payment by a Participating Provider within one hundred eighty (180) days from the end of the month in which the service was rendered to a Participating Patient, in accordance with the WPPA Agreements, must be paid within thirty (30) business days of Group's receipt of said claim. If a Clean Claim, covered under the Physician Provider Agreement, is not paid within thirty (30) business days of Group’s receipt of a Provider’s Clean Claim then the full-billed charges are due, plus 1.5% interest per month until paid. Late payment charges plus interest will not be imposed if the Group notifies the Participating Provider within the first thirty (30) business days of Group's receipt of Provider's original claim that the claim is not a Clean Claim as defined by the WPPA, with specific reasons given. Additional charges will not be imposed until the contracting Group has a Clean Claim as long as the delay is justified, and the Group notifies the Provider at least every 30-business days of the reason for the delay. The amount of deductibles, coinsurance, copayment and non-covered expenses owed by the Participating Patient shall not be increased by any of the additional charges resulting from the delay in payment. At no time may the Participating Provider seek payment of billed charges from a Participating Patient on a claim that is the responsibility of the Participating Group to pay. Late Payment Provision. Anything to the contrary contained in this Lease Agreement notwithstanding, in the event any payment of Base Rental is more than thirty (30) days past due, an administrative charge equal to five percent (5%) of such past due sum shall be due and payable by Lessee to Lessor, upon written demand. In addition, any sum more than thirty (30) days past due to the Lessor shall bear interest at the rate of twelve percent (12%) per annum (or the highest lawful rate allowable if less than 12%) until paid in full, with said interest to be due and payable by Lessee to Lessor, upon written demand.

Lessor shall have all legal, equitable and contractual rights, powers and remedies provided either in this Lease or by statute or otherwise in the case of non-payment of Rent.

  • Late Payments If any undisputed amount in an invoice of the Transfer Agent (for fees or reimbursable expenses) is not paid when due, the Fund shall pay the Transfer Agent interest thereon (from the due date to the date of payment) at a per annum rate equal to one percent (1.0%) plus the Prime Rate (that is, the base rate on corporate loans posted by large domestic banks) published by The Wall Street Journal (or, in the event such rate is not so published, a reasonably equivalent published rate selected by the Fund) on the first day of publication during the month when such amount was due.   • Late Payment Rent Late payment by Tenant to Landlord of Rent and other sums due will cause Landlord to incur costs not contemplated by this Lease, the exact amount of which will be extremely difficult and impracticable to ascertain.   • Late Payments; Default Rate If the Borrower fails to make any payment of principal, interest or other amount coming due pursuant to the provisions of this Note within fifteen (15) calendar days of the date due and payable, the Borrower also shall pay to the Bank a late charge equal to the lesser of five percent (5%) of the amount of such payment or $100.00 (the “Late Charge”). Both the Late Charge and the Default Rate are imposed as liquidated damages for the purpose of defraying the Bank’s expenses incident to the handling of delinquent payments, but are in addition to, and not in lieu of, the Bank’s exercise of any rights and remedies hereunder, under the other Loan Documents or under applicable law, and any fees and expenses of any agents or attorneys which the Bank may employ. In addition, the Default Rate reflects the increased credit risk to the Bank of carrying a loan that is in default. The Borrower agrees that the Late Charge and Default Rate are reasonable forecasts of just compensation for anticipated and actual harm incurred by the Bank, and that the actual harm incurred by the Bank cannot be estimated with certainty and without difficulty.
