LATE PAYMENT OF RENT definition

LATE PAYMENT OF RENT. Monthly payments due and payable on the first day of each month as provided in the Lease, which are not in the possession of Landlord's Agent by the due date, are subject to a service charge of $50.00 in each instance. Any rental payment not in the possession of Landlord's Agent by the tenth (10th) day of each month shall be subject to the additional payment of interest at the annual rate of ten percent (10%). Such interest shall be computed from the first day of each month for each unpaid monthly rental installment until paid in full. Any waiver of the collection of said service charge or said interest charge shall not prohibit the Landlord from collecting of such charges at some future date. All waivers of such charges shall be given by Landlord in writing to be effective.
LATE PAYMENT OF RENT. All monthly installments of rent herein stipulated are due in advance without prior offset or deduction, EXCEPT AS OTHERWISE PROVIDED HEREIN, on the FIRST (1ST) DAY OF EACH MONTH during the term hereof, as set forth in Section 3 hereof entitled "BASE RENT". All rents not received on the first (1st) day of the month shall be deemed "past due" and all rents not received by the Landlord WITHIN FIVE (5) BUSINESS DAYS FOLLOWING WRITTEN NOTICE THAT SUCH AMOUNT IS PAST DUE, SUCH NOTICE TO BE PROVIDED TWICE ANNUALLY, shall be subject to a charge of FIVE PERCENT (5%) of the amount due. In any such event, Landlord shall so invoice Tenant for any such charge, which shall become due immediately upon Xxxxxx's receipt of the invoice but in no event later than THIRTY (30) days from the invoice date. Once any payment of rent is thirty (30) days past due, the total due shall bear interest at TEN percent (10%) per annum.

  • Rent Payment Date means each date on which an installment of rent is due and payable pursuant to Section 5(a) hereof.

  • Base Rental means the amount of rent due to Landlord per square foot for the first year of the Term. Base Rental for the first year of Term shall be $24 per square foot for the building and $7.50 per square foot for the drive thru at the Premises.
