Common use of Law and Language Clause in Contracts

Law and Language. 30.1 The Agreement shall be construed and the provision of Card facilities shall be governed by Malaysian law, and subject to the non-exclusive jurisdiction of the Malaysian courts. 30.2 Any delay or failure by the Bank to exercise its rights and/or remedies under this Agreement does not represent a waiver of any of the Bank’s rights. 30.3 If, at any time, any of these terms and conditions are or become illegal, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining terms and conditions shall not be affected. 30.4 Nothing in this Agreement shall operate so as to exclude or restrict any liability of any party to this Agreement, to the extent that such exclusion or restriction is prohibited by the laws of Malaysia. 30.5 This Agreement supersedes any other agreement, letters, correspondence (oral or written or expressed or implied) entered into prior to this Agreement in respect of the matters dealt with in this Agreement and constitutes the entire Agreement between the parties with respect to the matters dealt with herein. Terms and conditions contained hereto in this Agreement shall be the basis for the formation of a contract between the Account Holder and/or Cardmember and the Bank. 30.6 In the event of any inconsistency or conflict between the English version and the Bahasa Malaysia version, the English version shall prevail. i) ANNUAL FEES Card type Classic (RM) Gold (RM) Platinum (RM)

The service tax will be collected on the date the Card type Classic is issued or renewed (RMas the case may be) Gold and subsequently on the anniversary of the date of issuance or renewal (RMas the case may be) Platinum (RM)of the Card.
