Common use of Lease of Parking Spaces Clause in Contracts

Lease of Parking Spaces. Tenant is obligated to lease the number of unreserved parking spaces on the roof level of the Project parking garage as specified in the Basic Lease Information and the number of reserved parking spaces on the third level of the Project parking garage as specified in the Basic Lease Information, throughout the Term and any extension thereof, subject, however, to the provisions of this Section 30.1. Tenant shall pay the parking rental being charged for such spaces, as the same may be increased from time to time, in advance, as Rent, on the first day of each month. The parking rental payable by Tenant hereunder may include taxes imposed on the use of the parking spaces by any governmental or quasi-governmental authority. The parking rental in effect as of the Lease Date is $190.00 per month for each unreserved parking space and $280.00 per month for each reserved parking space. The use of such spaces shall be for the parking of motor vehicles used by Tenant, its officers and employees only, and shall be subject to applicable Requirements. Parking spaces may not be assigned or transferred separate and apart from this Lease. Upon the expiration or earlier termination of this Lease, Tenant’s rights with respect to all leased parking spaces shall immediately terminate. Further, if Tenant fails to pay parking rental when the same shall be due, then, upon written notice from Landlord, in addition to all other remedies available to Landlord, Tenant’s rights with respect to all leased parking spaces shall immediately terminate. If Tenant’s rights to parking spaces terminate, Tenant shall not have any right to any such terminated parking for the remainder of the Term, and Landlord shall have no obligation to procure substitute parking for Tenant.

Upon the expiration or earlier termination of this Lease, or Tenant’s failure to pay parking rental when due (if any is so due hereunder) which such failure is not cured within ten (10) days following Notice from Landlord, Tenant’s rights with respect to all leased parking spaces shall immediately terminate. FurtherTenant shall have the right to reduce the number of parking passes allocated to Tenant pursuant to this Lease by giving Landlord written notice (a “Parking Notice”) specifying the number of passes Tenant no longer requires no later than fourteen (14) days prior to the first day of the next calendar month of the Term. Provided that Tenant has timely delivered the Parking Notice pursuant to this Section, if Tenant fails shall have no obligation to pay for the specified number of reduced parking rental when the same shall be due, then, upon written notice from Landlord, in addition to all other remedies available to Landlord, spaces and Tenant’s rights with respect to all leased such parking spaces shall immediately terminate. If Tenant’s rights to parking spaces terminate, Tenant shall not have any right to any such terminated parking for the remainder of the Term, and Landlord shall have no obligation to procure substitute parking for Tenant.

Upon the expiration or earlier termination of this Lease, Tenant’s 's rights with respect to all leased parking spaces shall immediately terminate. Further, if Tenant fails to pay parking rental when the same shall be due, and such failure shall continue for five (5) business days after written notice to Tenant of such delinquency, then, upon written notice from Landlord, in addition to all other remedies available to Landlord, Tenant’s 's rights with respect to all the applicable leased parking spaces shall immediately terminate. If Tenant’s rights to parking spaces terminate, Tenant shall not have any right to any such terminated parking terminate for the remainder of the Term. Tenant shall have the right, upon at least thirty (30) days' prior written notice to Landlord, to elect not to lease some or all of the parking spaces specified in the Basic Lease Information. If Tenant so relinquishes its rights to any allotted parking spaces, upon Tenant's written request to Landlord at any time, Tenant shall be eligible to release its relinquished parking spaces on a first-come, first-serve basis, receiving a preference over nontenants, and in any event Landlord shall have no obligation make such spaces available to procure substitute parking for Tenant within ninety (90) days after Landlord's receipt of Tenant's request to release such spaces.
