Common use of Lease of Project and Project Site Clause in Contracts

Lease of Project and Project Site. (s). 4.1. Contractor hereby leases the Project and the Project Site(s) to the District, and the District hereby leases said Project and Project Site(s) from Contractor upon the terms and conditions set forth in this Facilities Lease. 4.2. The leasing by Contractor to the District of the Project Site(s) shall not affect or result in a merger of the District’s leasehold estate pursuant to this Facilities Lease and its fee estate as lessor under the Site Lease. Contractor shall continue to have and hold a leasehold estate in the Project Site(s) pursuant to the Site Lease throughout the term thereof and the term of this Facilities Lease. 4.3. As to the Project Site(s), this Facilities Lease shall be deemed and constitute a sublease.
