Common use of Leave for Court Clause in Contracts

Leave for Court. Leave of absence without loss of regular pay shall be given to an Employee other than an Employee on leave of absence without pay or under suspension, who is required: (a) to serve on a jury (including the time spent in the jury selection process); or (b) by subpoena or summons to attend as a witness in any proceedings for an employment related matter held: (i) in or under the authority of a court or tribunal; or (ii) before an Arbitrator or person or persons authorized by law to make an inquiry to compel the attendance of witnesses before it. (c) by the Employer to appear as a witness in a legal proceeding, in which case the time involved shall be considered time worked. (d) The leave of absence under Article 24.20 shall be sufficient in duration to permit the Employee to fulfill the witness or jury obligation. (e) An Employee given Leave for Court without loss of regular pay shall pay to the Employer the amount that the Employee receives for this duty. This provision is not applicable to a Casual Employee.
