Common use of Leave of Absence for Family Care Clause in Contracts

Leave of Absence for Family Care. A family care leave, without pay, shall be granted, upon request by an employee for a total of up to six (6) consecutive months within a two (2) year period. The employee requesting the leave must have a minimum of one (1) year continuous service in the bargaining unit at the time of the request. The employee shall be guaranteed reinstatement in accordance with his seniority at the end of his leave. Any employee who wishes to change his or her date to return to work shall notify the Store Manager two (2) weeks in advance of the date they intend to return. The purpose of this leave shall be to care for seriously ill family members or to address issues that arise from the military deployment of a family member. For the purpose of this leave, "family members" shall be: 1. Spouse and parents of the employee. 2. Biological or adopted unmarried children under nineteen (19) years of age and full-time students up to age twenty-three (23). 3. A child of any age who is incapable of self-support. 4. Any relative residing in the employee's home and dependent upon the employee for care. The employee shall be required to present satisfactory evidence of serious illness of the family member, the expected duration of the absence, and the reason for the employee's involvement.
