Lessee's Percentage Share. The term “Lessee's Percentage Share,” except when said term refers to the cost of maintaining the Common Roadway, shall mean thirty-three and ninety-nine hundredths percent (33.99%). Lessor and Lessee acknowledge that Lessee's Percentage Share, except when said term refers to the cost of maintaining the Common Roadway, has been obtained by dividing the net rental area of the Premises, which Lessor and Lessee agree is 37,071 square feet, by the total net rental area of the Building, which Lessor and Lessee agree is 109,056 square feet, and multiplying such quotient by 100. Lessee’s Percentage Share shall not be subject to change, except for physical additions or deletions to the Premises or Building, or caused by condemnation or destruction.

Lessee's Percentage Share. Section 2.02 of the Lease is hereby amended to provide that: (a) effective for the time period commencing on the Expansion Commencement Date, the percentage to be used for Lessee’s share set forth in Section 2.02 of the Lease or otherwise used throughout the Lease, whether referenced as Lessee’s share, 5.01% or otherwise, is increased from 5.01% to 9.742%, and (b) effective from and after August 1, 2007, the base years over which Lessee shall pay its share of real estate taxes and other municipal or other public assessments, and operating expenses, shall be the fiscal year 2007 for real estate taxes and other municipal or other public assessments and the calendar year 2007 for operating expenses.
Lessee's Percentage Share. For purposes of Subsections 7.01 and 7.02 of this Lease, Lessee’s Percentage Share shall be determined by Lessor by dividing the Area of the Premises by the total rentable square foot Area of the Complex specified in item 7.04 of Exhibit B and multiplying the resulting quotient (at least to the second decimal place) by one hundred. If the total rentable square foot Area of the Complex decreases for any reason, the Base Year Operating Expenses and the Utility Costs Allowance shall also be reduced proportionally to the reduction in the square footage of the Complex. However, if the Area of the Complex increases, Lessee shall not be responsible for any costs of acquisition, construction, servicing, or maintenance of any major expansions or addition to the Complex during the term of this Lease.
