Common use of Level III - Mediation Clause in Contracts

Level III - Mediation. 7.4.1 If the Federation or District elects, the grievance may be referred to a mediator from the State Mediation and Conciliation Service (SMCS). Both the Federation and the District agree to participate in the process in good faith in an attempt to reach an equitable resolution. 7.4.2 Either the District or the Federation may contact SMCS for the assignment of the mediator. A meeting will be scheduled as soon as calendars can be arranged. 7.4.3 If the Federation and the District agree, they may use an alternative to the SMCS. 7.4.4 The costs of mediation are to be borne equally.

Any election of mediation must be made in writing by the requesting party within ten (10) business days of the date of the Level II written decision. 7.4.2 19.4.2 Either the District or the Federation may contact SMCS for the assignment of the mediator.
