Common use of Level III - Mediation Clause in Contracts

Level III - Mediation. If the grievant and/or the Association are not satisfied with the disposition of the grievance at Level II, the Association may refer the grievance to 7.4.3.1 The Association shall request that a mediator from the California State Mediation and Conciliation Service be assigned to assist the parties in the resolution of the grievance. 7.4.3.2 The mediator shall within 10 days of the receipt of the request or as soon as available, meet with the grievant, the Association, and the charter school representatives for the purpose of resolving the grievance. 7.4.3.3 If an agreement is reached, it shall be reduced to writing, and signed by the grievant, the Association, and the Charter School. Such agreement shall constitute a settlement of the grievance. 7.4.3.4 In the event that the grievant, the Association, and the Executive Director or their designee have not resolved the grievance with the assistance of the mediator within 10 days of the first mediation session, the Association may elect to terminate Level III and proceed to Level IV of the grievance procedure.
