Common use of Level III - Mediation Clause in Contracts

Level III - Mediation. 5.6.1. Within ten (10) days after receipt of the Superintendent or designee’s written decision from Level II, or the time limit expires without the issuance of the Superintendent or designee’s written decision, the aggrieved may submit the grievance to mediation with a mediator designated by the Public Employment Relations Board (PERB). A copy of the request for assignment of a mediator shall be provided to theDistrict. 5.6.2. The mediation meeting(s) shall be scheduled at the convenience of the mediator. If an agreement is reached at mediation, the agreement shall be reduced to writing and shall be signed by the aggrieved, the Association and the District. This agreement shall be non- precedential and shall constitute a settlement of the grievance. 5.6.3. If the aggrieved, the Association and the Superintendent or designee have not resolved the grievance with the assistance of the mediator, the Association may proceed to Level IV.
