Licensee's Risk. Licensee shall, at all times during the Term hereof and for such further time as Licensee shall occupy the Premises or any part thereof, keep all effects and property of every kind, nature and description of Licensee and of all persons claiming by, through or under Licensee which, during the continuance of this Agreement or any occupancy of the Premises by Licensee or anyone claiming under Licensee, may be in the Premises or in the Building, at the sole risk and hazard of Licensee, and if the same shall be lost or damaged by any cause, no part of said loss or damage is to be charged to or to be borne by Licensor, except that Licensor shall in no event be indemnified or held harmless or exonerated from any liability to Licensee or to any other person, for any injury, loss, damage or liability to the extent prohibited by law.
Licensee's Risk. (a) The Licensee occupies the Hangar Site and carries out any Works at its own risk.
(b) If the Licensee is obliged to do anything under this License, it does so at its own risk. Default, Essential Terms and Termination
Licensee's Risk. All property of the Licensee which may hereafter be located on, under, or over or adjacent to the Municipal Lands shall be at the sole risk of the Licensee and the City shall not be liable for any loss or damage thereto howsoever caused and the Licensee hereby releases the City from all actions, claims, demands, suits or proceedings whatsoever in respect of any such loss or damage, except and to the extent such loss or damage is caused by the negligence of the City or its servants or agents.
Licensee's Risk. Licensee's Risk. Licensee acknowledges that it and its agents, employees and invitees shall use the Space at their own risk to the maximum extent permitted by law and that Licensor shall not be liable to Licensee or its agents, employees or invitees for any loss or damage to Licensee or its agents, employees and invitees or their property in or upon the Space or anywhere on the property that may be caused by any accident, natural conditions, catastrophe, intentional destruction or vandalism, fire, theft, the acts or omissions of Licensor or other persons using or occupying the Space. It shall be the responsibility of Licensee to secure its own insurance or otherwise protect itself and its property against such loss or damage.
Licensee's Risk. Licensee assumes all risk with respect to the selection of the Hotel location, the acquisition of the right to possession thereof, and to the Construction of the Hotel, all on the basis of its own investigation and efforts. Licensor has no obligation to participate in any of these matters except as may be necessary to Licensor's decision whether to sign this Agreement or to determine compliance with System Requirements in deciding whether to allow the Hotel to open as a System Hotel. Any review of or involvement by Licensor in this process is for this purpose only and does not constitute a representation, warranty or guarantee that from a Construction, economic, business or any other standpoint the Property is suitable as a location for a System Hotel or that the Hotel is suitable for its intended purpose.
Licensee's Risk. The Licensee acknowledges and agrees that all property of the Licensee which may hereafter be located on, under, or over to the Permitted Roads shall be
Licensee's Risk. The entry upon and use of the Space and all other activities of Licensee in, on or about the Space shall be at the sole risk and expense of Licensee. Licensee has inspected the Space prior to the execution of this Agreement and agrees to accept the Space and access thereto in its present condition “as is”. Licensor shall not be liable for any damage to property of Licensee or injury to Licensee or its employees, agents or invitees due to the condition of the Space or Licensee’s use of the Space, except for conditions arising after the date of this Agreement due to Licensor’s gross negligence.
Licensee's Risk. The policies required are for Licensor's benefit and protection. Licensor makes no warranty or representation that the policies are adequate for Licensee's needs whatsoever. Licensee
