Licensing Requirements. All of the CONTRACTOR's network Providers must be licensed and/or certified by the appropriate South Carolina licensing body or standard-setting agency, as applicable. The CONTRACTOR shall: 2.4.1. Ensure all of the CONTRACTOR's network Providers/Subcontractors comply with all applicable statutory and regulatory requirements of the Medicaid Program and be eligible to participate in the Medicaid Program. 2.4.2. Be responsible for assuring that all persons, whether employees, agents, Subcontractors or anyone acting for or on behalf of the CONTRACTOR, are properly licensed at all times under applicable state law and/or regulations and are not debarred, suspended or otherwise ineligible from participation in the Medicaid and/or Medicare Program. 2.4.3. Ensure all health professionals and health care facilities used in the delivery of services by or through the CONTRACTOR possess a current license to practice or operate in the State in which the service is delivered. The Department may withhold part or all of the Capitation Payment due the CONTRACTOR if the service is provided or authorized by unlicensed personnel. The Department may also refer the matter to the appropriate licensing authority for action. 2.4.3.1.
