LIMITED MODIFICATION. Except as expressly modified above, the terms and conditions of the Employment Agreement shall remain in full force and effect, and the Company and the Executive ratify and confirm to each other the enforceability thereof.
LIMITED MODIFICATION. Except as expressly modified above, the terms and conditions of the Agreement as amended shall remain in full force and effect, the terms of which are hereby ratified and confirmed by Purchaser and Seller.

LIMITED MODIFICATION. Except to the limited extent expressly set forth herein, all other terms and provisions contained in the Third Consolidated Note and the Mortgage remain in full force and effect, and nothing herein and nothing done pursuant hereto shall affect or be construed to affect the lien, charge and encumbrance of, or warranty of title in the Mortgage, nor the priority thereof over other liens, charges, encumbrances or conveyances, and the Mortgaged Property (as that term is defined in the Mortgage) shall remain in all respects subject to the lien, charge and encumbrance of the Mortgage. This Extension Agreement constitutes a modification or amendment, and not a novation.

This Second Spreader constitutes a modification or amendment, and not a novation.
