LOAN RESCHEDULING. 7.1 The Borrower acknowledges that in the event of any instalment, or other payment, not being made on its due date, the Credit Provider shall be entitled (without prejudice to any other rights which the Credit Provider may have) to either demand repayment of the Loan (inclusive of capital, interest and other charges then outstanding) or to reschedule the Loan repayments, in which event a new schedule (Part A) will be deemed to have been executed by the Borrower in favour of the Credit Provider. 7.2 Without detracting from, and without prejudice to, the provisions of 7.1, the Borrower acknowledges that in the event of his/her loan repayments falling into arrears, the Credit Provider shall be entitled (but not obliged) to cancel the existing loan and reschedule the Loan repayments due by the Borrower, in which event: 7.2.1 The balance of the existing Loan inclusive of capital, interest and any and all other amounts or charges then owed by the Borrower to the Credit Provider (“the rescheduled capital”) will be calculated by the Credit Provider; 7.2.2 The rescheduled capital will be deemed a further Loan made by the Credit Provider to the Borrower; 7.2.3 The rescheduled capital together with interest thereon, insurance premiums and other charges, will be repayable by the Borrower to the Credit Provider by way of monthly instalments over a fixed period to be determined by the Credit Provider; 7.2.4 A schedule (Part A) in accordance with the terms of this Agreement will be deemed to have been executed by the Borrower; 7.2.5 The Borrower shall repay the rescheduled capital together with interest, insurance and all other charges in accordance with the provisions of the aforesaid schedule and the terms hereof.

  • Rescheduling (a) A Maintenance Outage and the associated Capacity Credit Period may be rescheduled if Seller’s request to reschedule is received by Buyer no later than 5:00 p.m. PPT on the day before the Maintenance Outage was previously scheduled to begin. (b) A Major Overhaul and the associated Capacity Credit Period may be rescheduled provided: (i) The rescheduled Major Xxxxxxxx begins six months or more after the first outage notification date and time; (ii) The notification to reschedule is made at least one week before the Major Overhaul was previously scheduled to begin; and (iii) There is at least a one-month period between the notification to reschedule and the commencement of the rescheduled Major Overhaul. (c) Maintenance Outages and Major Overhauls may be rescheduled more than once.

  • Rescheduling of Tests If the Authority’s Engineer certifies to the Authority and the Contractor that it is unable to issue the Completion Certificate, as the case may be, because of events or circumstances on account of which the Tests could not be held or had to be suspended, the Contractor shall be entitled to re-schedule the Tests and hold the same as soon as reasonably practicable.

  • Scheduling i) The designated employer will provide the employee with their schedule of shifts in accordance with the collective agreement for both homes. [Insert the split/sharing of shift numbers here] Similarly, the employee will submit all requests for time off including vacation to the designated employer in accordance with the collective agreement. ii) Posted schedules will include home identification.   • Self Scheduling The Home and the Union may agree to implement a self-scheduling process. Self-scheduling is the mechanism by which employees in a Home create their own work schedules. The purpose of self scheduling is to improve job satisfaction and quality of work life for the participating employees. Self scheduling requires a collaboration of employees and management to ensure proper coverage of the Home and to meet the provisions of the Collective Agreement. It is agreed that self scheduling will be negotiated locally by the Home and the Union and will include a trial period. Each Home must have the majority agreement of the full-time and part-time employees who vote on the issue to agree on a trial period of up to six months. Once the trial period is complete, each Home must have a minimum of 66⅔% agreement of the full-time and part-time employees who vote on the issue to continue with the new schedule on a permanent basis.

  • Scheduling Committee (a) The parties agree to the formation of a Scheduling Committee to discuss and assist in resolving scheduling issues. (b) The committee will be comprised of equal representation from the Union and management. One Union Representative shall be the Bargaining Unit President and one Management Representative shall be the Chief Nursing Officer or designate. (c) Terms of Reference will be developed and mutually agreed to by the Committee.

  • Scheduling of Vacation A) The Employer shall permit annual vacations to be taken during the entire year. B) The scheduling of vacations shall be subject to the operational requirements of the Employer. C) The selection of vacation and the posting of the approved vacation schedule shall be completed by December 31st of the preceding calendar year or any other date mutually agreed at the local level. Such local agreements shall be filed with the Union and Employer. D) Once the approved vacation schedule has been posted, it shall only be changed by mutual consent. E) Vacation entitlement accrued to June 30 (inclusive) shall be taken prior to January 1 in the following year unless otherwise required by operational necessity. Despite the above, where an employee’s vacation is cancelled by the Employer due to operational requirements, the employee may elect to carry over up to seven (7) days to be used no later than June 30 in the following year. Unused vacation shall be paid out at straight time rates by the last pay period of February of the following year. Payout shall not include any carryover of vacation pursuant to the above. F) Employees may, prior to the scheduling of vacations, request to have their vacations scheduled in accordance with either the principle of seniority or on a rotating basis. Where a consensus of employees cannot be reached as above, vacations shall be scheduled according to seniority on the basis that the employees with the most seniority shall have the first choice of vacation times. Employees failing to exercise their rights within the vacation selection time posted by the Employer shall forfeit their seniority rights in respect to choice of vacation time. G) Vacation time may be divided and shall be scheduled at a time mutually agreeable to the employee and the Employer, however, an employee who splits her vacation shall not receive her choice of when she wishes to take the subsequent portion of her vacation until all other employees in the unit or xxxx have made their first choice of vacation time.

  • Payment Scheduling The earliest possible Scheduled Payment Date for each Xxxxxx will be designated within the portion of the Site through which the Service is offered when you are scheduling the payment. Therefore, the Service will not permit you to select a Scheduled Payment Date less than the earliest possible Scheduled Payment Date designated for each Xxxxxx. When scheduling payments you must select a Scheduled Payment Date that is no later than the actual Due Date reflected on your Xxxxxx statement unless the Due Date falls on a non-Business Day. If the actual Due Date falls on a non-Business Day, you must select a Scheduled Payment Date that is at least one (1) Business Day before the actual Due Date. Scheduled Payment Dates must be prior to any late date or grace period. Depending on the method of payment, your Eligible Transaction Account may be debited prior to the Scheduled Payment Date. For example, if the selected method of payment is a draft, the draft arrives earlier than the Scheduled Payment Date due to expedited delivery by the postal service, and the Xxxxxx immediately deposits the draft, your Eligible Transaction Account may be debited earlier than the Scheduled Payment Date.

  • Provisioning 2.4.1 BellSouth shall provision services during its regular working hours. To the extent OneTone requests provisioning of service to be performed outside BellSouth’s regular working hours, or the work so requested requires BellSouth’s technicians or project managers to work outside of regular working hours, overtime charges set forth in BellSouth’s intrastate Access Services Tariff, Section E13.2, shall apply. Notwithstanding the foregoing, if such work is performed outside of regular working hours by a BellSouth technician or project manager during his or her scheduled shift and BellSouth does not incur any overtime charges in performing the work on behalf of OneTone, BellSouth will not assess OneTone additional charges beyond the rates and charges specified in this Agreement. 2.4.2 In the event BellSouth must dispatch to the End User’s location more than once due to incorrect or incomplete information provided by OneTone (e.g., incomplete address, incorrect contact name/number, etc.), BellSouth will xxxx OneTone for each additional dispatch required to provision the circuit due to the incorrect/incomplete information provided. BellSouth will assess the applicable Maintenance of Service rates from BellSouth’s XXX Xx. 0 Xxxxxx, Xxxxxxx 13.3.1.
