Local Grievance Procedures. Grievances filed in accordance with the provisions of this Article shall be processed as outlined below. 1. Level One - A teacher, teachers or the Association alleging a violation of the express provisions of this contract shall within ten (10) days of its alleged occurrence discuss the grievance with the building principal or other appropriate administrator to resolve same. At the time of such discussion, the grievant(s) or the Association shall indicate to the administrator that the discussion involves a possible grievance. If no resolution is obtained within three (3) days of the discussion, the teacher shall reduce the grievance to writing and proceed within five (5) days of said discussion to Level Two. 2. Level Two - A copy of the written grievance shall be filed with the Superintendent or designee as specified in Level One with the endorsement thereon of the approval or disapproval of the Association. Within five (5) days of receipt of the grievance, the Superintendent or designee shall arrange a meeting to discuss the grievance with the grievant and/or, at the option of the grievant, the designated Association representative. Within five (5) days of the discussion, the Superintendent or designee shall render a decision in writing, transmitting a copy of same to the grievant, the Association Secretary and, if applicable, the principal of the building in which the grievance arose. A copy of same will also be placed in a permanent file in the office of the personnel administrator. 3. Level Three- If the Association is not satisfied with the disposition of the grievance at Level Two, or if no decision is rendered at Level Two, it may, within ten (10) days after the Level Two decision, or expiration of the time therefore, submit the matter in writing to arbitration with the American Arbitration Association. Only the Association shall have the right to process grievances to Level Three. In such event, the grievance will be processed as described in Section F below.
