Loss of Other Coverage and the Right to Enroll. If an Eligible Individual or Dependent has elected not to participate in the Plan because he/she was covered under another group health plan or health insurance policy that provided hospital, medical, or surgical expense benefits (as defined under ERISA § 733(a)(1) at the time he/she was eligible to enroll), the Eligible Individual and/or Dependent may enroll in this Plan outside the Open Enrollment Period if he/she satisfies the requirements of a Special Enrollee in Section 2.41(c) of this Core Document. The right to this special enrollment must be exercised within thirty (30) days from the date that the alternative coverage terminates unless a longer time period has been elected by Plan Sponsor for Special Enrollees in the Adoption Agreement. The coverage for an individual who enrolls pursuant to this Section will commence on the date elected by Plan Sponsor in the Adoption Agreement.

Tenant does not rely on the fact, nor does Landlord represent, that any specific tenant or type or number of tenants shall, during the Lease Term, occupy any space in the Building or Project.

  • Owner’s Right to Make Changes Without invalidating the Contract, the Owner, by Change Order and without notice to the sureties, may authorize or order extra work or changes by altering, adding to, or deducting from the Work or the Contract Time, the Contract Sum being adjusted accordingly. All Change Orders shall be performed under the conditions of the original Contract except that any claim for extension of time caused thereby shall be adjusted at the time of signing of the Change Order. (See Change Order formats in Section 7.) Prior to the issuance of the Proceed Order, the Contractor and the Owner shall advise each other in writing of their designees authorized to accept and approve changes to the Contract Sum and the limits to each designee's authority. Should any designee or limits of authority change during the time this Contract is in effect, the Contractor or Owner shall give written notice to the other as provided in Article 1.1.5. There is no legal limitation on the Owner’s right to make changes such as may be, in the Owner’s sole discretion, useful or desirable to the Project.
