Right to Manage. Subject to the terms of this Agreement, the Union acknowledges the right of the individual Contractor to manage the business in which he is engaged and to direct the working forces, to discharge or discipline employees for just cause.
Right to Manage. Management retains and reserves the right to manage and control its business, its equipment, and its operations; adopt rules and policies; determine qualifications and assignments of employees; direct its personnel; determine the number of employees and schedule their work; discipline employees for just cause; direct the working forces, including hiring, evaluating, promoting, suspending, discharging, transferring, and laying off employees, as long as there is no conflict with the other provisions of this contract.
Right to Manage. The employer shall have the right to engage and dismiss employees and to determine the management of work. Collective bargaining proposed by either party shall commence where possible without delay. The parties may jointly request the opinion of EK and SAK on the interpretation of agreements. On separate agreement with the employer, representatives nominated by the parties shall be entitled to inspect conditions at the workplaces of the members that they represent. The national conciliator and the other parties shall be notified, where possible, no later than four days before any political or sympathetic industrial action is taken. The notice shall specify the causes of the intended industrial action, the time when it begins and the scope of the action.
Right to Manage. The Employer retains the full and unrestricted right to operate and manage all manpower, facilities and equipment; to establish functions and programs; to set and amend budgets; to determine the utilization of technology; to establish and modify the organizational structure; to select direct and determine the number of personnel; to establish work schedules; to contract for services without the need for further negotiations relating to implementation of the decision in respect to lime sludge hauling and parking lot attendants; to perform any inherent managerial function not specifically limited by this agreement. In respect to the contracting of the functions of parking lot attendants, the City would not terminate the services of existing employees but would not fill the affected positions when a vacancy arises. In respect to the functions of lime sludge hauling, existing employees affected by this decision would be utilized to perform other tasks while continuing to work in their present position of Heavy Equipment Operator II. The present positions of Heavy Equipment Operator II associated with lime sludge hauling will not be eliminated.
Right to Manage. The Employer reserves and retains, solely and exclusively, all of its inherent rights to manage the business. The Employer alone shall have the full and exclusive authority to determine and direct the policies, procedures and methods of operating its business. Without limiting the generality of the forgoing, the sole and exclusive rights of management which are not abridged by this Agreement include, but are not confined to, the right to determine, and from time to time, to re-determine the number, types and locations of its operations, and the methods, equipment and processes to be employed; to discontinue or automate methods, equipment, processes or operations; the right to determine the qualifications for new employees, and to select its employees; to determine the size and composition of its work force, to determine production and work schedules and methods of work and production; to determine the number and type of equipment, machinery, materials and supplies to be used or operated and the products to be prepared, processed or sold or the services to be rendered or supplied; to hire, promote, transfer, assign, lay off, and recall employees to work; to reprimand, discharge, or otherwise discipline employees; to determine job content and the amount and type of work needed; to determine and make the assignments of work; to schedule the hours to be worked on each job in each location and in each shift; to expand, reduce, alter, combine, transfer, assign or cease any job, job classification, department, or operation; to determine the amount of supervision necessary; to control and regulate or discontinue the use of supplies, equipment, machinery and process and any other property owned, used, leased or possessed by the Company; to establish, modify and enforce reasonable rules or regulations, policies and practices; to introduce new, different or improved methods, means and processes of transportation, production, maintenance, service and operation; and, otherwise, generally manage the operation and direct the work force; the Employer’s failure to exercise any function or right in any particular way shall not be deemed a waiver of its rights to exercise such function or right, nor to preclude the Employer from exercising the same, in some other way not in conflict with the express provisions of this Agreement.
Right to Manage. The employer shall be entitled to manage and distribute work, and to hire and dismiss a sala- ried employee.
Right to Manage. Nothing in this Agreement shall detract from or interfere with the right of Management to suspend, transfer, layoff, or discharge employees for just cause.
Right to Manage. The Board and the Superintendent reserve and retain the full right, authority, and discretion under governing local, state and federal law, ordinances, rules, regulations and Board policies, to control, supervise, and manage the East Hartford Public Schools and its employees. As such, the Board and Superintendent have the right to determine and assign the duties and responsibilities of the Employee.
Right to Manage. The Employer, on its own behalf and on behalf of its electors, hereby retains and reserves unto itself, without limitations, all powers, rights, authority, duties and responsibilities conferred upon and vested in it by the laws and the Constitution of the State of Michigan and of the United States. Further, all rights which ordinarily vest in and are exercised by employers, except such as are specifically relinquished herein, are reserved to and remain vested in the Employer, including but without limiting the generality of the foregoing, the right:
(a) to manage its affairs efficiently and economically, including the determination of quantity and quality of service to be rendered, the control of materials, tools and equipment to be used and the discontinuance of any services, material or methods of operation;
(b) to introduce new equipment methods, machinery, or processes, change or eliminate existing equipment and institute technological changes, decide on materials, supplies, equipment and tools to be purchased;
(c) to determine the size of the work force and increase or decrease its size;
(d) to hire, assign, lay off, and discharge employees, to reduce the work week, or the work day or effect reduction in hours worked by combining layoffs and reductions in work week or work day, to set hours of employment and to set times during the work day of all shifts;
(e) to direct the work force, assign work and determine the number of employees assigned to operations;
(f) to establish, change, combine or discontinue job classifications and prescribe and assign new job duties, content and classification; to establish the number of people needed or used in all classification;
(g) to make rules and regulations not inconsistent with the terms hereof.
Right to Manage. Club reserves the sole and exclusive right and authority to handle, decide, supervise, manage, and control the financial, business, administrative, and other matters with respect to its business, including, without limitation, the operation of the Venue and any other businesses in which it or its corporate affiliates has an interest or which is under its control, including the scheduling of all Games and Events, the hiring and firing of personnel, and any other administrative matters.
