M echanics’ Liens. Tenant shall keep the Site free and clear of all mechanics’ liens resulting from construction done by or for Tenant. Tenant shall have the right to contest the validity of any such liens if, within sixty (60) days demand by Landlord, Tenant procures a bond posted for such purpose or otherwise removes such liens from the Site. Tenant shall advise Landlord of any claim of a mechanic’s lien within ten (10) days following Tenant’s receipt of notice of such mechanic’s lien.

M echanics’ Liens. Subject to the right to contest the same prior to payment, Tenant agrees and shall keep the Property free and clear of all mechanics’ liens and other liens on account of work done by or for Tenant. Tenant shall indemnify, defend (with counsel reasonably acceptable to the City) and hold City’s Indemnities harmless from and against all liability, loss, damages, costs and expenses (including reasonable attorney’s fees) incurred by or brought against a Tenant or City for claims of lien of laborers or material men or others for work performed or materials or supplies furnished to Tenant or persons claiming under it. In the event any lien is recorded, Tenant shall, within twenty (20) days following such recordation, cause such lien to be removed of record by bonding or otherwise.
M echanics’ Liens. All bills and claims for labor performed and materials furnished to or for the benefit of the Property have been paid in full, and There are no actual or, to the best of Seller’s knowledge, impending mechanics or materialmens liens (whether pending or perfected) against the Property.
M echanics’ Liens. A Mechanic’s Lien waiver or satisfaction, in form and substance reasonably acceptable to Seller, from each engineer and contractor engaged by Buyer in connection with the subdivision of the parcels described on Exhibit B or this transaction, by which such parties release or waive any lien rights each party may have against Parcel 3 and/or Parcel 4 depicted on Exhibit A and described on Exhibit B attached hereto.
M echanics’ Liens. Tenant shall pay or cause to be paid all costs for work, labor, services or materials supplied to or performed on the Premises that might result in any mechanics’ lien or similar lien as and when Tenant is required to do so under Tenant’s agreement with the respective provider thereof. If Xxxxxx receives notice that any mechanics’ lien or any similar lien is recorded against the Premises and Tenant is not contesting such lien in accordance herewith, then Tenant shall cause such lien to be released and removed of record within thirty (30) days after Xxxxxx receives notice of the recordation of the mechanics’ lien or similar lien. Tenant shall indemnify, defend, release and save Landlord free and harmless from and against any and all claims of lien of laborers or materialmen or others for work performed or caused to be performed or for materials or supplies furnished for or at the Premises or Improvements by or for any Tenant Party and the Hotel Operator and all Related Costs.

  • Mechanic’s Liens Tenant shall not suffer or permit any mechanic's lien or other lien to be filed against the Premises, or any portion thereof, by reason of work, labor, skill, services, equipment or materials supplied or claimed to have been supplied to the Premises at the request of Tenant, or of anyone holding the Premises, or any portion thereof, by, through or under Tenant. If any such mechanic's lien or other lien at any time shall be filed against the Premises or any portion thereof, Tenant, within thirty (30) days after the date Tenant first becomes aware of the filing of the same, at Tenant's election, shall cause said lien either to be discharged of record or to be bonded over in a manner which is reasonably acceptable to Landlord. If Tenant shall fail to discharge such mechanic's lien or other lien or to bond over the same within such period, then Landlord may, but shall not be obligated to, discharge the same by paying to the claimant the amount claimed to be due or by procuring the discharge of such lien as to the Premises by deposit of a cash sum or a bond or other security, or in such other manner as is now or may in the future be provided by present or future law for the discharge of such lien as a lien against the Premises. Any amount paid by Landlord, or the value of any deposit so made by Landlord, together with all costs, fees and expenses in connection therewith (including reasonable attorneys' fees), together with interest thereon at the Maximum Rate of Interest, shall be repaid by Tenant to Landlord within thirty (30) days after demand therefor. Tenant shall indemnify, defend and hold harmless Landlord and the Premises from all losses, costs, damages, expenses, liabilities, suits, penalties, claims, demands and obligations, including, without limitation, reasonable attorneys' fees, resulting from the assertion, filing, foreclosure or other legal proceedings with respect to any such mechanic's lien or other lien.

  • Mechanics’ Lien Tenant understands and agrees that Tenant and anyone acting on Tenant’s behalf does not have the right to file for mechanic’s liens or any other kind of liens on the Premises. Tenant agrees to give actual advance notice to any contractors, subcontractors or suppliers of goods, labor or services that such liens are invalid. Tenant further agrees to take the additional steps necessary to keep the Premises free of any and all liens that may result from construction completed by or for Tenant.

Should Tenant fail to discharge the lien within thirty (30) days, then Landlord may discharge the lien. The amount paid by Landlord to discharge the lien (whether directly or by bond), plus all administrative and legal costs incurred by Landlord, shall be additional rent payable on demand. The remedies provided herein shall be in addition to all other remedies available to Landlord under this Lease or otherwise. The parties hereto agree that in no event shall the interest of Landlord be subject to the liens for improvements made by Tenant, and this expressly prohibits such liability. Pursuant to Section 713.10, Florida Statutes, this provision specifically provides that no interest of Landlord shall be subject to liens for improvements made by the Tenant at or under Tenant’s direction. This provision shall serve as notice to all potential construction lienors that Landlord shall not be liable for and the Facility Premises shall not be subject to liens for work performed or materials supplied at Tenant’s request or at the request of anyone claiming an interest by, through or under Tenant. Further, any contractor, vendor, supplier or other party providing work or services to and for the Premises that is entitled to a mechanic’s lien pursuant to Chapter 713, Florida Statutes, shall look solely to the leasehold interest of the Tenant in the Lease and may not encumber the fee title to the Premises owned by the Landlord. Tenant shall provide notice of this provision to all contractors, vendors, suppliers, and other parties providing work or materials at the Premises. The foregoing provision shall be included in any recorded notice under Section 713.10, Florida Statutes, or memorandum of this Lease.
