Common use of Maintenance of Group Insurance Clause in Contracts

Maintenance of Group Insurance. During the FMLA leave, eligible teachers may maintain coverage under the teacher’s group health plan including teacher dental and vision coverage, life, accidental death and dismemberment insurance at the same level and under the same conditions for which coverage would have been provided if the teacher had continued in active employment continuously for the duration of such leave. Teachers who contribute to such a group health plan must continue to make such contributions during the period of their leave in order to maintain coverage. The employer may recover the premium paid for maintaining a teacher’s health plan coverage during any period of unpaid leave if the teacher fails to return from leave after entitlement has expired, provided the teacher fails to return to work for a reason other than the continuation, recurrence or onset of a serious health condition that would entitle the teacher to leave, or other circumstances beyond the teacher’s control.
