Common use of Maintenance of PHI Clause in Contracts

Maintenance of PHI. Notwithstanding Section 5(j) of this Agreement, Business Associate and its subcontractors or agents shall retain all PHI throughout the term of the Agreement and shall continue to maintain the information required under §5(h) of this Agreement for a period of six (6) years after termination of the Agreement, unless Covered Entity and Business Associate agree otherwise.

Maintenance of PHI. Notwithstanding Section 5(j) 12 of this Agreement, Business Associate and its subcontractors or agents shall retain all PHI throughout the term of the Agreement and shall continue to maintain the information required under §5(h) Section 12 of this Agreement for a period of six (6) years after termination of the Agreement, unless Covered Entity and Business Associate agree otherwise.

Maintenance of PHI. Notwithstanding Section 5(jsubsection 3(k) of this Agreement, Business Associate and its subcontractors or agents shall retain all PHI throughout the term of the Agreement and shall continue to maintain the information required under §5(h) the various documentation requirements of this Agreement (such as those in subsection 3(h)) for a period of six (6) years after termination of the Agreement, unless Covered Entity and Business Associate agree otherwise.

Notwithstanding Section 5(j3(k) of this Agreement, Business Associate and its subcontractors or agents shall retain all PHI throughout the term of the Agreement and shall continue to maintain the information required under §5(h) the various documentation requirements of this Agreement (such as those in Section 3(h)) for a period of six (6) years after termination of the Agreement, unless Covered Entity and Business Associate agree otherwise.

Notwithstanding Section 5(jsection 4(k) of this AgreementAppendix, Business Associate and its subcontractors or contractors, Subcontractors, agents and representatives shall retain all PHI throughout the term of the Underlying Agreement and shall continue to maintain the information required under §5(hsection 4(h) of this Agreement Appendix for a period of six (6) years after termination of the Underlying Agreement, unless Covered Entity and Business Associate agree otherwise.

Notwithstanding Section 5(jsubsection 5(l) of this AgreementBAA, Business Associate and its subcontractors or contractors, subcontractors, agents and representatives shall retain all PHI throughout the term of the Underlying Agreement and shall continue to maintain the information required under §5(hsubsection 5(j) of this Agreement BAA for a period of six (6) years after termination of the Underlying Agreement, unless Covered Entity and Business Associate agree otherwise.
