Common use of Maintenance, Repairs, and Change Out Clause in Contracts

Maintenance, Repairs, and Change Out. 15.1 Licensee shall submit a written request for any maintenance or replacement of wireless telecommunications equipment. If the Licensor determines that the request does not require a full set of drawings, the Licensor will inform the Licensee that no further review is needed. However, if the Licensor determines that a new set of drawings is required, Licensee shall submit a Change Out Application, as shown on Exhibit E, a detailed set of drawings showing the current wireless telecommunications equipment being replaced and its associated replacement, and a fee of Four Thousand Dollars ($4,000), subject to increases as determined by the Licensor. Licensor’s appropriate operating group(s) shall review and approve the drawings. Upon approval, the Licensor's appropriate operating group(s) shall sign and date the drawings, which will then become a part of the Site License as Exhibit A. Unapproved wireless telecommunications equipment or improvements found on the Site may be considered a breach of the Master License Agreement and subject to corrective actions, up to and including termination of the Master License Agreement and/or Site License Agreement(s).
