MANAGEMENT SECURITY. 5.1 The Union and its officers, agents, and members agree that during the life of this Agreement, they shall not institute, promote, sponsor, engage in or condone any strike, slowdown, concerted stoppage of work, intentional interruption of Employer operation, or similar activity for any reason. Management shall have the right to discharge or otherwise discipline any employee who violates the provisions of this Article. The only question that may be raised in any proceeding (grievance, judicial or otherwise) adjudicating such action is whether the provision prohibiting strikes, slow- downs, concerted stoppages of work, intentional interruptions of Employer operations, or similar activities was violated by the employee to be discharged or otherwise disciplined. 5.2 A. The Union, its representatives, agents, members and any persons acting on their behalf agree that the following "other unlawful acts" as defined in Chapter 447, Florida Statutes, are expressly prohibited: (1) Soliciting public employees during working hours. (2) Distributing literature during working hours in areas where the actual work of public employees is performed, such as offices, warehouses, schools, police stations, fire stations, and any similar public installation. This Article shall not be construed to prohibit the distribution of literature during the employees’ lunch hour or in areas not specifically devoted to the performance of official duties.
