Managing Displaced Roles. In the event where business improvement activities, technological changes, circumstances beyond the control of the company or the Workplace Change Process result in a reduction in the size of Cement Australia’s workforce the following process will be followed to manage displaced employee(s). • Redundancy packages will be offered to employee(s) within the affected workgroup. • Redundancy packages will only be made available to employees within the broader workgroup if this action will create a suitable vacancy for the displaced employee(s). In such an event principal consideration will be given to the entry requirements for positions that will be potentially vacated. • The identified displaced employee(s) will be allocated alternative interim duties. A plan will be developed in conjunction with the displaced employee(s). The following will be considered within this plan: • Retraining the displaced employee(s) in displaced roles for other jobs, provided that the employee satisfies the entry requirements for such jobs • Attempting to redeploy displaced employee(s) to similar jobs, • Attempting to redeploy displaced employee(s) to other plant areas, provided that suitable vacancies are available in such areas and that the displaced employee(s) satisfy the entry requirements for such jobs • Using permanent employee(s) who are displaced instead of using contractors, provided it is cost effective • Potential for placement within the broader Cement Australia Group of companies on a transfer basis

  • Payment Limited to Satisfactory Services Contractor is not entitled to any payments from City until [insert name of department] approves Services, including any furnished Deliverables, as satisfying all of the requirements of this Agreement. Payments to Contractor by City shall not excuse Contractor from its obligation to replace unsatisfactory Deliverables, including equipment, components, materials, or Services even if the unsatisfactory character of such Deliverables, equipment, components, materials, or Services may not have been apparent or detected at the time such payment was made. Deliverables, equipment, components, materials and Services that do not conform to the requirements of this Agreement may be rejected by City and in such case must be replaced by Contractor without delay at no cost to the City.

  • Modified Indemnity Where Agreement Involves Design Professional Services Notwithstanding the forgoing, if the services provided under this Agreement are design professional services, as defined by California Civil Code section 2782.8, as may be amended from time to time, the defense and indemnity obligation under Section 1, above, shall be limited to the extent required by California Civil Code section 2782.8.

  • PROJECT REPRESENTATION BEYOND BASIC SERVICES 1.2.1. The State may at its option secure the services of a person or persons known as a Clerk-of-the-Works, referred to herein as a "Clerk". The Clerk(s) shall, for all purposes of this Agreement, report and be solely responsible to the State. The State may at any time dismiss the Clerk(s) for cause or convenience; however, any such action shall not affect the State's and ARCHITECT/ENGINEER'S obligations under this Agreement. In such event, the State shall use their best efforts to secure the services of a Clerk or Clerks under this paragraph as soon as is practicable if the State deems it necessary.
