Merchandise Discount. The Executive is eligible to receive a 40% merchandise discount off the retail price for items purchased in the Company’s stores for the Executive, or by the Executive as a gift for a friend or relative. All merchandise discount sales are subject to the terms and conditions of the Company’s written policies.

Merchandise Discount. Pursuant to Company policy, the Company will provide you with one non-transferable Company employee discount card each year. You will be entitled to the then existing standard corporate discount, but not the 50% discount or any other discount applicable only to employees. In order to receive your annual discount card, you must notify the Company’s Employee Relations department at the beginning of each calendar year. You agree to be bound by the Company policy regarding appropriate use of the discount card, and you understand that the use of any discount card will be revoked if there is a violation of the discount policy.
Merchandise Discount. The Company shall, through January 31, 2003, continue to provide Fiscxxx xxxh the discount(s) presently available to her on her purchase of merchandise for her personal use from the Company's stores and the stores of J. Pxxxxxxx Xx.; provided the Company shall cease to have any obligation under this Section 8 from and after the date that Fiscxxx xxxomes employed by another company in the women's retail clothing industry.
Merchandise Discount. During the Consulting Period, Executive will receive a discount on merchandise purchased from Cabela’s retail stores equal to, and under the same terms and conditions as, Executive’s current employee discount. Following the Consulting Period, Executive shall be eligible to receive a merchandise discount as a retired employee pursuant to Cabela’s then operating Employee Discount and Retirement Policy, if applicable.
Merchandise Discount. You will also be eligible for an employee discount of 40% off regular price merchandise and 25% off sale merchandise.

Nothing contained in this Section 12.09 or Section 12.03 shall limit the right of the holders of Senior Indebtedness to recover payments as contemplated by Section 12.02. The Trustee shall be entitled to rely on the delivery to it of a written notice by a person representing himself or itself to be a holder of such Senior Indebtedness (or a trustee on behalf of, or representative of, such holder) to establish that such notice has been given by a holder of such Senior Indebtedness or a trustee or representative on behalf of any such holder. In the event that the Trustee determines in good faith that further evidence is required with respect to the right of any person as a holder of Senior Indebtedness to participate in any payment or distribution pursuant to this Article XII, the Trustee may request such person to furnish evidence to the reasonable satisfaction of the Trustee as to the amount of Senior Indebtedness held by such person, the extent to which such person is entitled to participate in such payment or distribution and any other facts pertinent to the rights of such person under this Article XII, and if such evidence is not furnished, the Trustee may defer any payment which it may be required to make for the benefit of such person pursuant to the terms of this Indenture pending judicial determination as to the rights of such person to receive such payment. The Trustee shall not be deemed to owe any duty to the holders of Senior Indebtedness and shall not be liable to any such holders if the Trustee shall in good faith mistakenly pay over or distribute to Holders of Securities or to the Company or to any other person cash, property or securities to which any holders of Senior Indebtedness shall be entitled by virtue of this Article XII or otherwise. With respect to the holders of Senior Indebtedness, the Trustee undertakes to perform or to observe only such of its covenants or obligations as are specifically set forth in this Article XII and no implied covenants or obligations with respect to holders of Senior Indebtedness shall be read into this Indenture against the Trustee.
