MERS Mortgage Loans. With respect to each MERS Mortgage Loan, a MIN has been assigned to the Mortgage Loan, the MIN appears on the Mortgage or related Assignment of Mortgage to MERS, the Mortgage or the related Assignment of Mortgage to MERS has been duly and properly recorded on MERS, and the transfer to the Purchaser has been properly reflected in the MERS System pursuant to the Purchaser’s registration instructions;
MERS Mortgage Loans. With respect to each MERS Mortgage Loan, a MIN has been assigned by MERS and such MIN is accurately provided on the related Mortgage Loan Schedule. The related Assignment of Mortgage to MERS has been duly and properly recorded or has been delivered for recording to the applicable recording office. With respect to each MERS Mortgage Loan, the Seller has not received any notice of liens or legal actions with respect to such Mortgage Loan and no such notices have been electronically posted by MERS;
MERS Mortgage Loans. No Mortgage Loan is a MERS Mortgage Loan;
MERS Mortgage Loans. With respect to each Mortgage Loan registered on the MERS® System, the Seller shall notify MERS of the transfer of servicing of each Mortgage Loan to the Purchaser. All expenses incurred in compliance with this Section 5.11 shall be allocated between the Purchaser and the Seller in accordance with Section 19.03 of the Master Purchase Agreement.
MERS Mortgage Loans. With respect to each Serviced Mortgage Loan registered on the MERS System, the Sellers shall notify MERS of the transfer of servicing of such Serviced Mortgage Loan to Purchaser. All expenses incurred in compliance with this Section 7.10(k) shall be allocated 50% to Purchaser and 50% to the Sellers. With respect to each Serviced Mortgage Loan that is not registered on the MERS System, the Sellers shall deliver such notices, assignments and other documentation as is necessary to effect the transfer of servicing of such Serviced Mortgage Loan to Purchaser and the transactions contemplated hereby.
MERS Mortgage Loans. With respect to each MERS Mortgage Loan, Servicer shall cause the MERS System to indicate that the related Purchased Asset is being serviced by Servicer pursuant to the Agreement (including the Servicing Annex) by entering in the MERS System the information required by the MERS System to identify Servicer as the servicer of the MERS Mortgage Loan. In the event Servicer’s membership in MERS is terminated for any reason and any of the related Purchased Assets then serviced by Servicer are MERS Mortgage Loans, Servicer shall, upon Buyer’s request, prepare and cause MERS to execute and deliver an Assignment of Mortgage in recordable form to transfer the Mortgage from MERS to Buyer or its designee and to execute and deliver such other notices, documents and other instruments as may be necessary or desirable to effect a transfer of such Purchased Asset.
MERS Mortgage Loans. With respect to each MERS Mortgage Loan, a MIN has been assigned by MERS and such MIN is accurately provided on the related Mortgage Loan Schedule. The related assignment of Mortgage to MERS has been duly and properly recorded;
MERS Mortgage Loans. With respect to each MERS Mortgage Loan, the Seller shall, on or prior to the related Closing Date, designate the Purchaser as the Investor and the Custodian as custodian, and no Person shall be listed as Interim Funder on the MERS System. In addition, on or prior to the related Closing Date, the Seller shall provide the Custodian and the Purchaser with a MERS Report listing the Purchaser as the Investor, the Custodian as custodian and no Person as Interim Funder with respect to each MERS Mortgage Loan.
MERS Mortgage Loans. With respect to each MERS Mortgage Loan, a MIN has been assigned to the Mortgage Loan, the MIN appears on the Mortgage or related Assignment of Mortgage to MERS, the Mortgage or the related Assignment of Mortgage to MERS has been duly and properly recorded on MERS, and the transfer to the Purchaser has been properly reflected in the MERS System pursuant to the Purchaser’s registration instructions; (yy) Arbitration. With respect to each Mortgage Loan, neither the related Mortgage nor the related Mortgage Note requires the Mortgagor to submit to arbitration to resolve any dispute arising out of or relating in any way to the Mortgage Loan transaction;
MERS Mortgage Loans. As of the Sale Date and Servicing Transfer Date, each Mortgage Loan is a MERS Mortgage Loan.
