In the event a Local Union either fails, or is unable, to refer qualified minority or female applicants in percentages equaling Project affirmative action goals as set forth in the County’s bid specifications, the Contractor may employ qualified minority or female applicants from any other available source.

MINORITY AND FEMALE REFERRALS. In the event a Local Union either fails, or is unable, to refer qualified minority or female applicants in percentages equaling Project affirmative action goals as set forth in the CountyDepartment’s bid specifications, and the appropriate governmental authority determines that the Union’s efforts in referring applicants to meet those goals is not sufficient to satisfy the Contractor’s obligation to meet those goals, the Contractor may employ qualified minority or female applicants from any other available sourcesource in the minimum numbers needed to satisfy its obligation.
