Misuse of Licensed Software. In the event Seller has knowledge or has reason to believe that Buyer is using the Licensed Software beyond the scope of the license granted under this Agreement, Seller shall notify Buyer of the alleged misuse, in writing, in accordance with the clause entitled "Notices.” Upon receipt of such notice, or in the event Buyer itself has reason to believe that misuse of the Licensed Software may be occurring, Buyer shall promptly investigate the alleged misuses and shall destroy any unauthorized copies to the Licensed Software, or submit a written request to any Seller for authorization to continue using some or all of them, and in either case pay any license fees owed for such copies. Buyer shall provide Seller with a written report that summarizes the results of Xxxxx’s investigation into the alleged misuse and what actions Xxxxx took to correct it. THIS IS SELLER’S SOLE AND EXCLUSIVE REMEDY FOR MISUSE OF THE LICENSED SOFTWARE SO LONG AS BUYER PERFOMS ITS INVESTIGATION AND MAKES PAYMENT TO SELLER IN A TIMELY FASHIION.

Misuse of Licensed Software. Misuse of Licensed Software or data generated by the Licensed Software by Licensee, or any 3rd party allowed to operate or access the Licensed Software by Licensee (e.g. software or Equipment maintenance engineer) (jointly and separately “Licensee Party”), is strictly prohibited and may violate Dutch, EU and other applicable laws and may subject Licensee to substantial liability including indemnification per Article 15 hereof. Licensee is and shall be solely responsible for any misuse of the Licensed Software under this XXXX and for any liability or damage related in any way to Licensee Party’s use of the Licensed Software in violation of this XXXX. Licensor denies and rejects any and all responsibility due to misuse of the Licensed Software and / or a violation of this XXXX, such responsibility rests with the party misusing or having misused the Licensed Software and / or violating or having violated the XXXX, which is unequivocally agreed and acknowledged by Licensee and/ or Licensee Party. Licensee shall also be responsible for a Licensee Party’s use of the Licensed Software in accordance with the limitations of this XXXX.
Misuse of Licensed Software. In the event Vendor has knowledge or has reason to believe that DSM is using the Licensed Software beyond the scope of the license granted under this Agreement, Vendor shall notify DSM of the alleged misuse, in writing, in accordance with the clause entitled "Notices.” DSM shall provide Vendor with a written report that summarizes the results of DSM’s investigation into the alleged misuse and what actions DSM took to correct it. THIS IS VENDOR’S SOLE AND EXCLUSIVE REMEDY FOR MISUSE OF THE LICENSED SOFTWARE SO LONG AS DSM PERFOMS ITS INVESTIGATION AND MAKES PAYMENT TO VENDOR IN A TIMELY FASHIION.
Misuse of Licensed Software. The limited warranty set out in Sections 8.1 above shall not cover any defects or errors: (i) caused by or related to misuse, misapplication or any modification of the Licensed Software except for Permitted Modifications; or (ii) use on a computer hardware and operating system platform not supported by Cepos InSilico; or (iii) any use of any release of the Licensed Software that is no longer supported by Cepos InSilico (as defined in Exhibit B).

Related to Misuse of Licensed Software

  • Licensed Software Computer program(s) provided by Contractor in connection with the Deliverables, subject to Section 14 of this Contract.

  • Third Party Software Any portion of the Software that constitutes third party software, including software provided under a public license, is licensed to You subject to the terms and conditions of the software license agreements accompanying such third party software, or as set forth in the thirdpartylicenses.txt file accompanying the Software.

  • Software License Subject to the terms of this Agreement, Viasat grants to you a personal, non-exclusive, non-assignable and non-transferable license to use and display the software provided by or on behalf of Viasat (including any updates) only for the purpose of accessing the Service ("Software") on any computer(s) on which you are the primary user or which you are authorized to use. Our Privacy Policies provide important information about the Software applications we utilize. Please read the terms very carefully, as they contain important disclosures about the use and security of data transmitted to and from your computer. Unauthorized copying of the Software, including, without limitation, software that has been modified, merged or included with the Software, or the written materials associated therewith, is expressly forbidden. You may not sublicense, assign, or transfer this license or the Software except as permitted in writing by Viasat. Any attempt to sublicense, assign or transfer any of the rights, duties or obligations under this license is void and may result in termination by Viasat of this Agreement and the license. You agree that you shall not copy or duplicate or permit anyone else to copy or duplicate any part of the Software, or create or attempt to create, or permit others to create or attempt to create, by reverse engineering or otherwise, the source programs or any part thereof from the object programs or from other information made available under this Agreement.

  • Third Party Technology The Company makes use of third party technology to collect information required for traffic measurement, research, and analytics. Use of third party technology entails data collection. We therefore would like to inform clients the Company enables third parties to place or read cookies located on the browsers of users entering the Company’s domain. Said third parties may also use web beacons to collect information through advertising located on the Company’s web site. Please note that you may change your browser settings to refuse or disable Local Shared Objects and similar technologies; however, by doing so you may be disabling some of the functionality of Company’s services.
