Misuse of position Clause Samples

The 'Misuse of position' clause is designed to prevent individuals in positions of authority or trust within an organization from exploiting their role for personal gain or to the detriment of the organization. This clause typically applies to directors, officers, employees, or agents, and prohibits actions such as using confidential information for personal benefit or making decisions that create conflicts of interest. Its core function is to uphold ethical standards and protect the organization from harm caused by the improper use of power or influence.
Misuse of position. Using your official position to get something you are not entitled to, or to get someone else something they are not entitled to, is prohibited. Causing someone else to do these things is also prohibited. (See Sections 23(b)(2) and 26). A municipal employee may not use her official position to get something worth $50 or more that would not be properly available to other similarly situated individuals. Similarly, a municipal employee may not use her official position to get something worth $50 or more for someone else that would not be properly available to other similarly situated individuals. Misuse of position. A Council member shall not use his or her position at SCHOOL to attempt to influence the decision of any SCHOOL employee to grant special treatment to (a) the child or ▇▇▇▇ of the member, (b) any relative of the member, or (c) any "Related Party" as defined in the Council’s Conflict of Interest Policy. Every Council member and every SCHOOL employee who is a parent or ▇▇▇▇ of a SCHOOL student shall inform his or her child that he or she is required to follow all rules, policies and procedures applicable to SCHOOL students, that he or she is not entitled to special treatment by virtue of the relationship with a Council member or employee, and that any attempt to seek such special treatment may result in disciplinary action.
