Misuse of Promotion Codes. Licensee acknowledges that the right to use a Promotion Code in order to receive a discount for any License Fee, Annual License Fee, or any other fee is governed by the qualifying status of the Licensee. Licensee may not use a Promotion Code for which they do not qualify. Licensee also agrees and acknowledges that Licensee is fully responsible for ensuring that they are qualified to use a Promotion Code when processing a payment with LEAP. Licensee also agrees that if Licensee uses a Promotion Code for which they do not qualify, that Licensee is required to immediately remit to LEAP the value of the discount ( in $US Dollars) provided by the Promotion Code plus an administrative fee of 10% of the same value. By way of example, if Licensee misuses a Promotion Code which provides a $500 discount, Licensee would be required to immediately remit to LEAP a payment in the amount of $550. $550 = $500 discount plus $50 administrative fee (10% x $500).

A complete and accurate list of Contractor's employees and of all of its subcontractors' employees who may come in contact with District pupils during the course and scope of the Contract is attached hereto; and/or _ Pursuant to Education Code section 45125.2, Contractor has installed or will install, prior to commencement of work , a physical barrier at the Project site, that will limit contact between Contractor's employees and District pupils at all times; and/or _ Pursuant to Education Code section 45125.2, Contractor certifies that all employees will be under the continual supervision of, and monitored by, an employee of the Contractor who the California Department of Justice has ascertained has not been convicted of a violent or serious felony.
