Monthly Fixed Rent. Subtenant shall pay Sublandlord the Monthly Fixed ------------------ Rent in advance on the first calendar day of each month included in the Term, commencing on the Rent Commencement Date; and for any portion of a calendar month at the beginning of or end of the Term, the corresponding fraction of the Monthly Fixed Rent in advance. Monthly Fixed Rent shall include HVAC, nightly janitorial service, electricity for lights and plugs and one security guard from 4 p.m. to 8a.m. Monday through Friday, with security available on call throughout the weekends.
Monthly Fixed Rent. Tenant shall pay to Landlord as fixed rent for the Premises, monthly payments of FOUR THOUSAND EIGHT HUNDRED SEVENTY FOUR DOLLARS ($4,874.00) each, in advance, without deduction, off-set or demand, on the first day of each month of the term hereof with the initial month's rent being prorated. The basic monthly rental shall be adjusted at the end of a three (3) year period to reflect any increase in the consumer price index (all items) published by the U.S. Labor Department for the first month of the three year period compared to the last month of the lease term. Rent shall be payable in lawful money of the United States to Landlord at the address stated herein or to such other persons or at such other places as Landlord may designate in writing from time to time.
Monthly Fixed Rent. One-Twelfth of the Fixed Rent, the monthly amount of which is set forth in Exhibit F annexed hereto and made a part hereof.
Monthly Fixed Rent. In addition, if the Initial Lease Term commences on a day other than the first day of a calendar month, Tenant shall pay to Landlord, on or before the Lease Commencement Date, a pro rata portion of the monthly installment of rent (including Fixed Rent and any Additional Rent as herein provided), such pro rata portion to be based on the actual number of calendar days remaining in such partial month after the Lease Commencement Date. If the Initial Lease Term or Option Lease Term shall expire on other than the last day of a calendar month, such monthly installment of Fixed Rent and Additional Rent, as hereinafter defined, shall be prorated for each calendar day of such partial month.
Monthly Fixed Rent. (a) Tenant shall commence paying rent for the Additional Space on November 1, 1996. Effective November 1, 1996, the monthly Fixed Rent for the entire 32,804 square feet of the Subleased Premises shall be $24,603. Such monthly Fixed Rent shall be increased, effective March 1, 1997 through June 30, 2002, to $26,243.20 per month. (b) Commencing July 1, 2002, monthly Fixed Rent shall be increased to $32,804; provided however, that if Tenant believes that the Fair Market Rent is less than $1.00 per square foot of Rentable Area, Tenant may request that the Fair Market Rent be determined in accordance with Section 25.4 of the Master Lease, and upon completion of the determination of Fair Market Rent as provided therein, the rent shall be established in accordance with such appraisal, provided however that in no event shall the monthly Fixed Rent be less than $.76 per square foot of Rentable Area and in no event shall the monthly Fixed Rent exceed $1.00 per square foot of Rentable Area. (c) Commencing July 1, 2004 and each two years thereafter (the "ADJUSTMENT DATE"), the monthly Fixed Rent, as established above, shall be adjusted to reflect the percentage change in the Consumer Price Index (the "INDEX") that has occurred during each preceding two-year period in the Consumer Price Index (the "INDEX") that has occurred during each preceding two-year period. For purposes hereof, the Index shall be the United States Department of Labor, Bureau of Labor Statistics Consumer Price Index for All Urban Consumers San Francisco- Oakland-San Jose Xxxropolitan Area Average, Subgroup "All Items" (1982-84 = 100). The monthly Fixed Rent shall be adjusted on the Adjustment Date to an amount determined by multiplying the Fixed Rent for the month immediately preceding the Adjustment Date by a fraction, the denominator of which shall be the most recent monthly Index figure published prior to the previous Adjustment Date (or July 1, 2002 in the case of the first adjustment) and the numerator of which shall be the most recent monthly Index figure published prior to the date of such adjustment. If at any Adjustment Date the Index no longer exists in the form described herein, Landlord may substitute any substantially equivalent official index published by the Bureau of Labor Statistics or its successor. Monthly Fixed Rent. Upon Bankruptcy Court approval no later than October 22, 2003, and only while the Tenant is not operating the Premises as a call center, $3,333.34 per month shall be paid to Landlord which will not be applied to the purchase price. When Tenant operates the Premises as a call center, but in any event no later than December 1, 2003, Tenant shall pay Landlord $6,666.67 per month for the Property, Building and the personal property of which $3,333.34 per month paid shall be applied to the purchase of the Premises if Tenant buys them.
