Nature du Service. Le Service comprend l'application logicielle du Service faisant l'objet d'une licence accordée au titre de la section 5 ci- dessous ainsi que des logiciels ou services tiers (dans la mesure permise par les fournisseurs tiers) (ci-après désignés comme les « Services/Logiciels de tiers »). Le Service intègre également l'utilisation de microgiciels dans vos Actifs et Dispositifs télématiques. Le Service est mis à disposition des Utilisateurs autorisés par nous-même, nos concédants de licence et des fournisseurs tiers qui fournissent du contenu et des services en association avec ou via l'application logicielle du Service (ci- après désignés comme les « Fournisseurs tiers »). Vous reconnaissez que les Données et le Service seront fournis par radio, téléphone portable, satellite, GPS, Internet et toute technologie similaire. Vous acceptez une telle transmission et renoncez à toute réclamation quant à la disponibilité, la qualité et la performance du mode de fourniture des Données et du Service que vous pourriez avoir à notre encontre à ce sujet. Vous comprenez que le Service est mis à disposition des Utilisateurs Autorisés en fonction de différents facteurs, y compris, notamment, l'accès à Internet, l'utilisation d'un ordinateur, l'Actif, le système d'exploitation, le Dispositif télématique activé et xxxx par vos soins, le niveau de Services achetés, le nom d'utilisateur ou encore le mot de passe. Le Service pourra faire l'objet de modifications à tout moment, comme décrit dans la section 8 ci-après. En accédant ou en utilisant le Service et le Site, vous acceptez les ajouts, modifications ou retraits apportés aux fonctionnalités ou services accessibles en association ou via le Service ou le Site.

  • Nature of Service 3.1 ISO-NE and the NYISO shall, to the maximum extent each deems consistent with the safe and proper operation of its system, the furnishing of economical, dependable and satisfactory services by its participants, and the obligations of its participants to other parties, make available to the other Party when a system Emergency exists on the other Party's system, Emergency Energy from its system's available generating capability in excess of the system’s load requirements (i.e., load requirements alone, not load plus reserve requirements) up to the transfer limits in use between the two Balancing Authority Areas. Emergency Energy is provided in cases of emergency outages of generating units, transmission lines or other equipment, or to meet other sudden and unforeseen circumstances such as forecast errors, or to provide sufficient Operating Reserve. Normally, a Party requests Emergency Energy from the other Party as a last resort, when market-based real-time energy transactions are not available, or not available in a timely fashion in order to maintain its ten-minute reserve requirement. At the time the Emergency Energy sale is being initiated, the Party delivering such Emergency Energy shall describe the Emergency Energy transaction as being one of the following: (1) “delivered out of ten-minute reserve”; (2) “delivered out of thirty-minute reserve” where such a delivery could reasonably be expected to be recalled if the Party delivering the Emergency Energy needed the generation for a reserve pick-up or other Emergency; or (3) “delivered above and beyond ten-minute and thirty-minute reserves” where the Party delivering such Emergency Energy is normally expected to be able to continue delivering the energy following a reserve pick-up.

  • Autism Services This plan covers the following services for the treatment of autism spectrum disorders. • Applied behavior analysis when provided and/or supervised by an individual licensed by the state in which the service is rendered. See the Summary of Medical Benefits for the amount that you pay. • Physical therapy, occupational therapy, and speech therapy services when rendered as part of the treatment of autism spectrum disorder. A benefit limit will not apply to these services. • Psychological and psychiatric services, and prescription drugs are also covered. See Behavioral Health Services and Prescription Drugs and Diabetic Equipment or Supplies for additional information. Coverage for autism spectrum disorders does not affect any obligation of a school district, a state or other governmental entity to provide services to an individual under an individualized family service plan, an individualized education program, or similar services required under state or federal law. Services related to autism that are furnished by school personnel are not covered under this plan.

  • COMMERCIAL REUSE OF SERVICES The member or user herein agrees not to replicate, duplicate, copy, trade, sell, resell nor exploit for any commercial reason any part, use of, or access to 's sites.

  • DEPENDENT PERSONAL SERVICES 1. Subject to the provisions of Articles 16, 18 and 19, salaries, wages and other similar remuneration derived by a resident of a Contracting State in respect of an employment shall be taxable only in that State unless the employment is exercised in the other Contracting State. If the employment is so exercised, such remuneration as is derived therefrom may be taxed in that other State.
