Net Sales Price. The term "Net Sales Price" means the Gross --- ----- ------ Sales Price, net of expenses for transportation, shipping, insurance, boxing, handling or similar charges, taxes and duties, if any, and other costs incidental to shipment.
Net Sales Price. The Net Sales Price as defined in and determined in accordance with the Maytown Agreement.
Net Sales Price. The gross sales price, less quantity and cash discounts actually allowed, and less adjustments for sales, use and other similar taxes, and any transportation and delivery charges directly carried by COMPANY, and applied to all products or processes utilizing UNIVERSITY or Joint Intellectual Property, in whole or in part.
Net Sales Price. The volume-weighted average net price per gallon of each individual component of Plant Products received by MarkWest from unaffiliated third parties for all Plant Products sold at MarkWest's Siloam facility during the applicable Accounting Period, or as applicable, for Plant Products not sold at the Siloam facility, the Net Sales Price shall be a calculated amount netted back to the Siloam facility after deduction of all unaffiliated third party transportation related charges and, in the event of affiliated transportation charges, the actual costs, to include MarkWest owned railcar amortization costs (which amortization costs shall not exceed $0.02 per gallon), incurred from the Siloam facility in connection with that sale. In no event shall marketing fees be deducted from the Net Sales Price.
Net Sales Price. The volume-weighted average net sales price per gallon of each individual component of the Plant Products received by MarkWest, or by an affiliated agent of MarkWest, from unaffiliated third party purchasers (excluding any sales to affiliates of MarkWest) for all Plant Products sold by MarkWest or by an affiliated agent of MarkWest at the Siloam Facility during the applicable Accounting Period, or for Plant Products not sold at the Siloam Facility, the net sales price shall be a calculated amount of the proceeds from unaffiliated third party purchasers (excluding any sales to affiliates of MarkWest) netted back to the Siloam Facility after deduction of all unaffiliated third party transportation and storage related charges and, in the event of affiliated transportation charges, the actual costs, to include amortization costs for railcars owned by MarkWest or its affiliates **.
Net Sales Price. The "Net Sales Price" referred to in paragraph 4.2 shall mean the invoiced price for a Product less insurance, transport, bona fide rebates and allowances to the extent identified on the invoice, and less returns and less the purchase price of Raw Materials purchased by Licensee from Lanxide or its Affiliates. The "Net Sales Price" applicable to transfers to Licensee's Affiliates will be the price at which such Products would be sold at the time in question on an arms-length basis to a third party. Where Products are sold or transferred as part of a Subsystem and not separately, the Net Sales Price will be that percentage of the Net Sales Price of the Subsystem equal to the cost of manufacture of the Products divided by the cost of manufacture of the total Subsystem.
Net Sales Price. As used in this Agreement, the term “net sales price” shall mean the purchase price for the Unit(s) only as set forth in the sales contract therefore, excluding: (i) the cost of extras, optional features, upgrades, furniture packages or other charges to the Client, (ii) all price reductions, credits, incentives, and/or any other type of seller concession; (iii) interest earned on the xxxxxxx money deposit or on any purchase money financing of the Unit(s) by Developer.
Net Sales Price. The Net Sales Price shall be the actual sales price of the product net of taxes, freight for shipment from Licensee, actual discounts, and returns.
Net Sales Price. The term “Net Sales Price” means, for the purposes of computing royalties under this Agreement, SUBLICENSEE’s aggregate gross invoice price on the sale of Licensed Products during period for royalties are being calculated, less returns or refunds during such period, but before deduction of any other items, including but not limited to freight allowances and cash discounts.
