Price of the Product. 1.16.1. The Product Price (as defined in Article I.16.2 below applies to both the Initial European Doses
Price of the Product. Medeva shall use commercially reasonable efforts to obtain the best in-market price for the Product in the Territory under the prevailing marketing conditions; provided, however, that nothing in this Section 6.4 shall be deemed to restrict the freedom of Medeva to determine in its sole discretion prices for the Product for approved indications in the Territory; and provided, further, that in evaluating the best in-market price Medeva need not make such determinations on an indication by indication basis but may have due regard to the deleterious effects that pricing differentials among the indications might have on any particular indication. Medeva shall keep Anthra informed of its efforts in this regard in response to Anthra's reasonable written requests from time to time. *** CONFIDENTIAL TREATMENT REQUESTED.
Price of the Product. The price of the Product is set forth in Appendix #2 to this Agreement save otherwise agreed by the Parties in the respective Orders.
Price of the Product. Subject to applicable governmental regulations, Prodesfarma shall use commercially reasonable efforts to obtain the best in-market price for the Product in each country in the Territory under the prevailing marketing conditions; provided, however, that nothing in this Section 4.4 shall be deemed to restrict the freedom of Prodesfarma to determine prices for the Product in the Territory. Prodesfarma shall keep Anthra informed of its efforts in this regard in response to Anthra's written requests from time to time.
Price of the Product. I.16.1. The Product Price (as defined in Article I.16.2 below applies to both the Initial European Doses and the Additional European Doses.
I.16.2. The "Product Price" for the Product per dose shall be EUR [*****].
I.16.3. The Product Price (including, for the avoidance of doubt, the up-front payments on the Product Price pursuant to Article I.17.1 below), is exclusive of sales, value-added and other taxes, as well as customs and import fees and duties (sales, value-added and other taxes, as well as customs and import fees and duties together, the "ancillary expenses") to the delivery site. Such ancillary expenses will be charged in addition to the Product Price if applicable and provided that no exemption for the respective participating Member State applies.
I.16.4. The participating Member States will be responsible, at their own expenses and risks, for any secondary distribution, storage and administration of the Product.
I. 17. Payment obligations
I.17.1. Up-front payment
(a) In order to de-risk the necessary investments of the contractor to increase the speed of vaccine research and development and clinical trials and the preparation of the at-scale production capacity along the entire production value chain in the EU required for a rapid deployment of the millions of doses of the Product according to the terms of this APA, and in full understanding of the uncertainties associated with the aforementioned process, subject to EU marketing authorisation or temporary national authorisation (as the case may be), the Commission, acting on behalf and in the name of the participating Member States, and the participating Member States themselves shall contribute to financing the relevant costs in the form of an up-front payment on the total Product Price of the Initial European Doses (the "up-front payment") as set forth in this Article I.17.1 as well as in the form of the second upfront payment as set forth in Article I.17.2 and, as the case may arise, in the form of the Additional Doses up-front payment as set forth in this Article I.17.2.
(b) The up-front payment is EUR [*****] total (which will equal an up-front payment of EUR [*****]).
(c) Within [*****] calendar days following entry into force of the APA, the contractor shall send to the Commission a payment request for the payment of the up-front payment in accordance with Article II.15 below.

Price of the Product. 10.1 The price calculation (10.2) is based on the provisional price (as the “Provisional Price”) for Ferro Niobium which is as follows:
(a) the low unknown quotation for the Product for the week prior to the date that delivery of the Product is made or any other week mutually agreed upon (with such week being the “Quotation Period”) as published in the Metal Pages “Ferro-niobium 65% Nb (EU)” Index (in either case, the “Pricing Publication”); or
(b) if applicable pursuant to Section 10.2(a) below, such other price as the Buyer and the Seller may agree for a particular Order prior to the initiation of such Order, acting reasonably and having due regard for the then- prevailing market conditions; or
(c) If the Parties are unable to agree on such other price (pursuant to Section 10.1(b) above) for a particular Order within 10 working days from the date of the Order, then Buyer shall not have an obligation to either take delivery of or pay for Product under such Order and the amount of Product reflected in such Order shall reduce the Buyer’s obligations under clause 3.2(a) for that year.
10.2 The price to be paid by the Buyer to the Seller for the Product shall be calculated as follows: The Provisional Price, which is based on the Metal Pages “Ferro-niobium 65% Nb (EU)” Index (as specified in Section 10.1(a) above):
(a) less such discount deducted or plus such premium added, by the Buyer to Buyer’s customers, as agreed by Buyer and Seller
Price of the Product. The parties agree that "Molimentales", its subsidiaries, affiliates, agents, parent companies, subsidiaries, affiliates, predecessors, successors, assigns, related parties and/or legal representatives and any other person related thereto shall have to pay "Evonik" for the price of the product to be supplied, after having been delivered in the San Francisco mine located on Xxxxxxxxxx Street, no number, in the town of Estacion Llano, Sonora, Mexico. The cost of the product will be US$3,500.00 (three thousand five hundred dollars and 00/100 U.S. Cy) per metric ton, beginning June 1st, 2012. The price agreed in this document will not include VAT—Value Added Tax (IVA) or any other tax or fees that will be billed additionally to "Molimentales". The contracting parties acknowledge that the basic raw materials for preparing sodium cyanide, subject of the sale involved herein, are hydrocyanic acid and caustic soda, therefore acknowledging that production costs of hydrocyanic acid is mainly influenced by prices of raw material called methane gas (natural gas) and ammonia. By virtue of the above, "Evonik" and "Molimentales" give their consent and undertake to adopt a price adjustment formula to ensure that the price of sodium cyanide to be supplied to "Molimentales" remains being compatible with costs of the raw material used for their manufacture. Similarly, both parties agree that beginning on September 1st, 2012, the price of sodium cyanide will be adjusted in January, April, July and October of each year, in force from the next February 1st, May 1st, August 1st, and November 1st, respectively, according to the following computation formula: DAP mine San Francisco site price per metric ton in USD = ex Obregon price (P) + transportation costs. Price of the Product. 7.1 The price per unit of PRODUCT shall be fixed mutually by the Parties hereto according to the market-place for similar products in each of the geographical areas defined as TERRITORY herein, after research undertaken by TUTIMPEX within a maximum delay of ninety (90) days from the execution of this Agreement.
7.2 The price per unit of PRODUCT, once established, shall be in US dollars, FOB NEUROBIOTECH'S factory and shall not be increased for one (1) full year from the date of its implementation.
7.3 In any event, the sale price may be modified at any time if all of the Parties agree to such modification in writing.
7.4 Any increase in price shall take into account increases in actual costs of manufacturing and materials of the PRODUCT, including NEURO-BIOTECH'S normal profit margin thereon, and other appropriate related factors
Price of the Product. 7.1 The Trader agrees to pay the Producer a market-related price at the time of delivery of the Products or a fixed price, as set out in the Table below, whichever is the greater.
Price of the Product. All prices shall be quoted and invoiced in Czech Krona (CZK). Notwithstanding the dispositions of Annex 1, section 4, after Novartis Gene Therapy confirms that the price established in the RFQ issued for each patient shall be valid and maintained until such Order is completed. Prices are designated and treated as a business secret. The Hospital shall not provide information to third parties concerning unit price of the Product, except when legally required.
