TRANSPORTATION AND STORAGE. (a) When Products are ready for shipment, Siemens will: (i) inform Xxxxx, and Buyer will then promptly give shipping instructions to Siemens; (ii) determine the method of transportation and shipment routing; and (iii) ship the Products with freight prepaid by normal transportation. If Buyer fails to provide timely shipping instructions, Siemens will ship the Products by normal transportation means to Buyer or to a storage location selected by Siemens. Buyer will pay or reimburse any excess transportation charges for special or expedited transportation.

Students found to be changing passwords, exchanging devices, or changing passwords will be subject to disciplinary action and may lose their device. No other profiles, other than those created by KCA, will be allowed to be created. Only students who are issued a device may use them. Creating other profiles on your device is considered misused. If a student gives another student or person access to their device, that student giving the device will be held accountable for anything that occurs during that time. If a student attempts to hack, damage, or misuse another person’s device, they will be held accountable for any damage, fees, and will receive disciplinary action.

TRANSPORTATION AND STORAGE. NJRES may enter into storage and transportation capacity contracts with interstate and intrastate pipelines, storage operators and LDCs. Capacity contracts grant the right but not the obligation to utilize the pipeline or storage capacity for a set volume and a set period of time in exchange for a defined monthly demand charge. NJRES may elect to hedge this capacity through a combination of physical and financial trades. In addition, NJRES may enter into financial basis positions for the express purpose of speculation. The volumes associated with these capacity contracts and any physical or financial trades designed to either hedge the capacity or used for speculation are all included in the total position calculations and are subject to the limits identified in Exhibit 3 A&B. Any net volumetric difference would be an “open position”. The volume limits in Exhibit 3A are differentiated between those that require notification to RMC if exceeded, and those that are violations if exceeded.
