New Revision to Authority Loan and Note Amount. In order to retain Xxxx # 000 as affordable housing, the Housing Authority agreed to revise the amount of the Authority Loan to reflect the current 2013 “affordability gap”, and revise the Authority Loan amount to Forty Thousand Dollars ($40,000) (the “Authority Loan”), which is secured by this Note SUBJECT TO THE ADJUSTMENTS, CONDITIONS AND RESTRICTIONS SET FORTH HEREIN. Maker acknowledges that the Authority Loan will not actually be paid in cash to the Authority or the Developer, but represents the Affordability Gap. Maker executes, and deliver to Authority this amended promissory note in favor of Authority, as holder, in the principal amount of the Authority Loan (the “Note Amount”,“Note” or “Promissory Note”), together with an amended Deed of Trust. No interest shall accrue on the Note Amount. The Note Amount shall become earlier due and payable upon the sale, transfer or refinancing of the Property or upon default of this Agreement. Any remaining amounts of the Note Amount which have not earlier become due and payable shall be forgiven in full upon the forty-fifth (45th) anniversary of the Original 2008 Note. AS A CONDITION OF THIS LOAN MODIFICATION, THE PARTIES AGREE TO MODIFY AND ADJUST THE AMOUNT OF THE AUTHORITY NOTE FROM TIME TO TIME AS SET FORTH IN THIS SECTION. THE ADJUSTMENT TO THE AUTHORITY NOTE SHALL OCCUR ON AN AGREED UPON DATE DURING AN OPEN ESCROW TO CONVEY THE UNIT TO A PROPOSED BUYER AND AFTER THE AUTHORITY DETERMINED AND VERIFIED THAT THE HOUSEHOLD INCOME OF A PROPOSED BUYER IS AN ELIGIBLE PERSON OR FAMILY (AS SUCH TERMS AND ALL CAPITALIZED TERMS ARE DEFINED HEREINAFTER), AND DETERMINED WHETHER THE PROPERTY IS AVAILABLE TO SUCH BUYER AT AN AFFORDABLE HOUSING COST. AT THAT TIME, THE AUTHORITY SHALL DETERMINE IF THE AMOUNT OF THE AUTHORITY LOAN REFLECTS THE THEN CURRENT CORRECT “AFFORDABILITY GAP” AS SPECIFIED IN RECITAL D ABOVE. IN THE EVENT THE “AFFORDABILITY GAP” IS GREATER THAN OR LESS THAN THE AMOUNT OF THE AUTHORITY NOTE, (WHICH IS $40,000) THEN THE NOTE AMOUNT SHALL BE ADJUSTED DURING ESCROW AND ONLY APPLICABLE TO THAT APPROVED SALE. FOR EXAMPLE, IF PARTICIPANT DESIRES TO SELL THE UNIT WITH A FAIR MARKET VALUE OF $200,000 AND AN AFFORDABLE SALES PRICE VALUED AT $170,000, THE $30,000 DIFFERENCE IS THE NEW AFFORDABILITY GAP, AND AS SUCH THE AUTHORITY NOTE WILL BE ADJUSTED ACCORDINGLY.   • ENHANCED AND SUPPLEMENTAL SERVICES BY COUNTY (Continued) 2 ongoing services that SHERIFF otherwise would provide to CITY pursuant to 3 this Agreement. Such supplemental services shall be provided only by 4 regularly appointed full-time peace officers, at rates of pay governed by a 5 Memorandum of Understanding between COUNTY and the bargaining unit 6 representing the peace officers providing the services. Such supplemental 7 services shall include only law enforcement duties and shall not include 8 services authorized to be provided by a private patrol operator, as defined in 9 Section 7582.1 of the Business and Professions Code. Law enforcement 10 support functions, including, but not limited to, clerical functions and forensic 11 science services, may be performed by non-peace officer personnel if the 12 services do not involve patrol or keeping the peace and are incidental to the 13 provision of law enforcement services. CITY shall reimburse COUNTY its 14 full, actual costs of providing such supplemental services at an amount 15 computed by SHERIFF, based on the current year's COUNTY law 16 enforcement cost study. The cost of these supplemental services shall be in 17 addition to the Maximum Obligation of CITY set forth in Subsection G-2 of 18 this Agreement.   • AGENCY SERVICE FEE Section 1. Each employee who elects not to join or maintain membership in the Union shall be required to pay as a condition of employment, beginning thirty (30) days following the commencement of his/her employment, an agency service fee to the Union in an amount that is equal to the amount required to become and remain a member in good standing of the exclusive bargaining agent.

  • Repayment of Amounts Advanced for Network Upgrades Upon the Commercial Operation Date, the Interconnection Customer shall be entitled to a repayment, equal to the total amount paid to the Participating TO for the cost of Network Upgrades. Such amount shall include any tax gross-up or other tax-related payments associated with Network Upgrades not refunded to the Interconnection Customer pursuant to Article 5.17.8 or otherwise, and shall be paid to the Interconnection Customer by the Participating TO on a dollar-for-dollar basis either through (1) direct payments made on a levelized basis over the five-year period commencing on the Commercial Operation Date; or (2) any alternative payment schedule that is mutually agreeable to the Interconnection Customer and Participating TO, provided that such amount is paid within five (5) years from the Commercial Operation Date. Notwithstanding the foregoing, if this LGIA terminates within five (5) years from the Commercial Operation Date, the Participating TO’s obligation to pay refunds to the Interconnection Customer shall cease as of the date of termination. Any repayment shall include interest calculated in accordance with the methodology set forth in FERC’s regulations at 18 C.F.R. §35.19a(a)(2)(iii) from the date of any payment for Network Upgrades through the date on which the Interconnection Customer receives a repayment of such payment. Interest shall continue to accrue on the repayment obligation so long as this LGIA is in effect. The Interconnection Customer may assign such repayment rights to any person. If the Large Generating Facility fails to achieve commercial operation, but it or another Generating Facility is later constructed and makes use of the Network Upgrades, the Participating TO shall at that time reimburse Interconnection Customer for the amounts advanced for the Network Upgrades. Before any such reimbursement can occur, the Interconnection Customer, or the entity that ultimately constructs the Generating Facility, if different, is responsible for identifying the entity to which reimbursement must be made.

  • Authorization Required Prior to Parallel Operation 2.2.1 The NYISO, in consultation with the Connecting Transmission Owner, shall use Reasonable Efforts to list applicable parallel Operating Requirements in Attachment 5 of this Agreement. Additionally, the NYISO, in consultation with the Connecting Transmission Owner, shall notify the Interconnection Customer of any changes to these requirements as soon as they are known. The NYISO and Connecting Transmission Owner shall make Reasonable Efforts to cooperate with the Interconnection Customer in meeting requirements necessary for the Interconnection Customer to commence parallel operations by the in-service date.
