NEXT Department Assets Sample Clauses

NEXT Department Assets. The parties agree that full and complete compensation for the full scope of the Work associated with the NEXT Department Assets is included within this Agreement as of the Second Amended and Restated Agreement Date, and nothing within the scope of such Work will, in and of itself, entitle the Concessionaire to any additional relief (including a Delay Event or a Compensation Event). Notwithstanding the foregoing, if a Delay Event or a Compensation Event occurs that impacts the performance of Work relating to the NEXT Department Assets, the Concessionaire will be entitled to seek relief in accordance with this Agreement. The NEXT Department Assets shall be turned over to the Department, and the care, custody and control and risk of loss (other than as covered by any applicable warranty) of the NEXT Department Assets shall transfer to and vest with the Department, in accordance with a turnover and allocation plan and maintenance maps to be agreed upon by the parties, as may be mutually updated by the parties from time to time, as well as the Joint Operating and Maintenance Protocols attached hereto as Exhibit E, as may be mutually updated by the parties from time to time.

  • Monitoring by the Department The Contractor shall permit all persons who are duly authorized by the Department to inspect and copy any records, papers, documents, facilities, goods, and services of the Contractor that are relevant to this Contract, and to interview clients, employees, and sub-contractor employees of the Contractor to assure the Department of satisfactory performance of the terms and conditions of this Contract. Following such review, the Department shall deliver to the Contractor a written report of its finding, and may direct the development, by the Contractor, of a corrective action plan. This provision shall not limit the Department’s termination rights.

  • RESPONSIBILITIES OF THE DEPARTMENT The Department agrees to:

  • Fire Department Service Charge We will pay up to $500 for your liability assumed by contract or agreement for fire department charges incurred when the fire department is called to save or protect covered property from a Peril Insured Against. We do not cover fire department service charges if the property is located within the limits of the city, municipality or protection district furnishing the fire department response. This coverage is additional insurance. No deductible applies to this coverage.

  • Maintenance Department All employees in this section are subject to the provisions of the Collective Agreement except as specifically covered in this section.

  • Department Liaison In performing the Services provided for in this Agreement, Contractor’s liaison with the [insert name of department] will be [insert name of contact person in department].

  • Obligations of the Department a. The Department shall notify Business Associate of a) any limitation in any applicable Notice of Privacy Practices that would affect the use or disclosure of PHI by the Business Associate and b) any changes, revocations, restrictions or permissions by an individual to the use and disclosure of his/her PHI to which the Department has agreed, to the extent such restrictions or limitations may affect the performance of Business Associate’s services on behalf of the Department.

  • Interstate Educational Personnel Contracts 1. The designated state official of a party state may make 1 or more contracts on behalf of his state with 1 or more other party states providing for the acceptance of educational personnel. Any such contract for the period of its duration shall be applicable to and binding on the states whose designated state officials enter into it, and the subdivisions of those states, with the same force and effect as if incorporated in this agreement. A designated state official may enter into a contract pursuant to this article only with states in which he finds that there are programs of education, certification standards or other acceptable qualifications that assure preparation or qualification of educational personnel on a basis sufficiently comparable, even though not identical to that prevailing in his own state.
