Common use of Night Duty Clause in Contracts

Night Duty. 151. Employees shall be paid ten percent (10%) more than the base rate for each hour regularly assigned between 5:00 p.m. and 7:00 a.m. if the employee works at least one (1) hour of the shift between 5:00 p.m. and 7:00 a.m., except for those employees participating in an authorized flex-time program and who voluntarily work between the hours of 5:00 p.m. and 7:00 a.m.. Shift pay of ten percent (10%) shall be paid for the entire shift, provided at least five (5) hours of the employee's shift falls between 5:00 p.m. and 7:00 a.m.

Employees shall be paid ten eight percent (108%) more than the base rate for each hour regularly assigned worked between 5:00 p.m. and 7:00 a.m. if provided that the employee works employees’ regular shift includes at least one (1) hour of the shift between 5:00 p.m. and 7:00 a.m., except for those employees participating in an authorized flex-time program and who voluntarily work between the hours of 5:00 p.m. and 7:00 a.m..
