Common use of NO DISCRIMINATION OR INTIMIDATION Clause in Contracts

NO DISCRIMINATION OR INTIMIDATION. 5.01 It is agreed that there will be no discrimination or intimidation by the Company, the Union, or their respective representatives, against any employee because of his Union or non-Union affiliation or because of his activity or lack of activity in the Union. 5.02 It is further agreed that there will be no solicitation of members, collection of dues, telephone usage for Union business, or other Union activity on the premises of the Company during working hours, without first obtaining permission from the immediate representative of Management. 5.03 The Company and the Union agree that they shall not discriminate against any employee because of race, creed, colour, age, sex, marital status, nationality, ancestry or place of origin in accordance with the provisions of The Ontario Human Rights Code. The Company and the Union agree that every person has the right to be free from harassment in accordance with the provisions of the Ontario Human Rights Code. 5.04 It is understood that wherever this Agreement refers to "he", it is intended to mean "he" or "she".
