No Harassment Clause. 21.1. Nondiscrimination. During the performance of this Agreement, Construction Manager and its Subconsultants must not unlawfully discriminate against any employee or applicant for employment because of race, religion, color, national origin, ancestry, physical or mental disability, medical condition, Acquired Immune Deficiency Syndrome or HIV status (AIDS/HIV status), marital status, age (over 40), sex, or sexual orientation. Construction Manager must ensure that the evaluation and treatment of employees and applicants for employment are free of discrimination.
