No Hazardous Materials Activities. During the Term, the Developer shall not cause or permit the Property, or the Improvements thereon to be used as a site for the use, generation, manufacture, storage, treatment, release, discharge, disposal, transportation or presence of any Hazardous Materials.

No Hazardous Materials Activities. Developer hereby represents and warrants to the City that, at all times from and after the Closing Date, Developer shall not cause or permit any portion of the properties or the Improvements thereon to be used as a site for the use, generation, manufacture, storage, treatment, release, discharge, disposal, transportation or presence of any Hazardous Materials with the exception for the use and storage of minimal quantities as required for the operation of the Improvements as an automobile sales and full service auto repair facility (which may include auto body repair pending City approval).
No Hazardous Materials Activities. Developer shall not knowingly permit the Property or any portion thereof to be a site for the use, generation, treatment, manufacture, storage, disposal or transportation of Hazardous Material or otherwise knowingly permit the presence or release of Hazardous Material in, on, under, about or from the Property except: (x) as may be authorized by an agency of applicable jurisdiction, (y) for cleaning supplies and other materials in volumes and concentrations customarily used in construction, rehabilitation, use or maintenance of residential properties similar in nature to the Property and any commercial uses developed as part of the Development, and used, stored and disposed of in compliance with Environmental Laws; and (z) as may otherwise be allowed under Environmental Laws. For avoidance of ambiguity only, nothing in the previous sentence shall limit Developer from maintaining Hazardous Materials existing on the Property prior to the Commencement Date or consolidating such Hazardous Materials on the Property, all to the extent permitted by law.
No Hazardous Materials Activities. The Developer hereby represents and warrants to the City that, at all times from and after the Closing Date, the Developer shall not cause or permit the Residential Property or the Residential Improvements thereon to be used as a site for the use, generation, manufacture, storage, treatment, release, discharge, disposal, transportation or presence of any Hazardous Materials, except to the extent such Hazardous Materials were present on or about the Site prior to the Closing Date. The Developer hereby represents and warrants to the City that, at all times from and after the Closing Date until the expiration of the Garage License Agreement, the Developer shall not cause or permit the Garage Property or the Garage Improvements thereon to be used as a site for the use, generation, manufacture, storage, treatment, release, discharge, disposal, transportation or presence of any Hazardous Materials, except to the extent such Hazardous Materials were present on or about the Site prior to the Closing Date.
No Hazardous Materials Activities. The Lessee hereby represents and warrants to the City that, at all times from and after the Closing Date, the Lessee shall not cause or permit the Land or the Improvements thereon to be used as a site for the use, generation, manufacture, storage, treatment, release, discharge, disposal, transportation or presence of any Hazardous Materials, except to the extent such Hazardous Materials were present on or about the site prior to the Closing Date.

  • No Hazardous Materials (A) have been disposed of or otherwise released from any Real Property of the Company or any of its Subsidiaries in violation of any Environmental Laws; or

  • Materials and Improvements Title to materials, improvements, and other property required of PURCHASER by this contract shall vest in and become the property of STATE at the time such are furnished by PURCHASER and accepted by STATE. All existing improvements located on State land, and any improvements placed on State land by PURCHASER which become the property of STATE, shall be safeguarded by PURCHASER.
