No Liens; No Impairment of Owner’s Ability to Perform. Except as provided in the TCAP Loan Documents, nothing has occurred which has or may result in the creation of any lien, charge, or encumbrance upon the Premises or anything affixed to or used in connection with the Premises or Work or which has or may substantially and adversely impair the ability of Owner to make all payments of principal and interest on the Recapture Note, the ability of Owner to meet its obligations under the Sub-award Documents or, to the best of its knowledge, the ability of any Guarantor to meet its obligations under the Guaranty.

  • Owner’s Right to Perform Work The Owner reserves the right to perform construction or operations related to the Project with Separate Contractors on the Site. If the Contractor claims that delay or additional cost is because of such action by the Owner, the Contractor shall assert such claims as provided in Section 5, Part 2 of the General Conditions.
