No Mortgage. Developer shall not: (i) record or file any mortgage or financing statement covering all or any portion of the Project Site, the Project, or the materials to construct the Project, in any public office, except financing statements in favor of the Payment Rights Purchaser; or (ii) cause or permit any such mortgage or financing statement to be recorded or filed.
No Mortgage. Tenant shall not mortgage, pledge or otherwise encumber its interest in this Lease or in the Premises.

Loan is (a) subject to the provisions of the Homeownership and Equity Protection Act of 1994 as amended (“HOEPA”), (b) a “high cost” mortgage loan, “covered” mortgage loan or “predatory” mortgage loan or any other comparable term, no matter how defined under any federal, state or local law, (c) subject to any comparable federal, state or local statutes or regulations, or any other statute or regulation providing for heightened regulatory scrutiny or assignee liability to holders of such mortgage loans, or (d) a High Cost Loan or Covered Loan, as applicable (as such terms are defined in the current Standard & Poor’s LEVELS® Glossary Revised, Appendix E);
No Mortgage. Landlord represents and warrants to Tenant that as of the date of this Third Amendment, neither the Premises, the 800 Building, the 900 Building nor the Center is subject to any existing ground lease, mortgage, deed of trust, sale/leaseback transaction or any other hypothecation for security.
No Mortgage. Landlord represents and warrants that there is no mortgage or deed of trust encumbering the 100 Building.
No Mortgage. PRF shall not: (i) record or file any mortgage or financing statement covering all or any portion of the Project Site, the Acquisition Property, or the materials to construct the Project, in any public office, except financing statements in favor of the Payment Rights Purchaser; or (ii) cause or permit any such mortgage or financing statement to be recorded or filed.
No Mortgage. Lessee shall not: (i) record or file any mortgage or financing statement covering all or any portion of the Premises, or the materials to construct the Water Tower, in any public office, except financing statements and other evidence of liens in favor of the Payment Rights Purchaser; or (ii) cause or permit any such mortgage or financing statement to be recorded or filed.
No Mortgage. Landlord represents to Tenant that as of the date of this Lease, there is no mortgage related to premises. Although no mortgage is planned, Landlord reserves its rights to enter a mortgage relationship subject to the terms herein.
No Mortgage. The Licensee must not grant a mortgage of this Premises Licence or otherwise use the Premises Licence as security for any financial facility.
