The Licensee must. (a) independently obtain and pay for any equipment or software necessary to use the CAL 1 Standards Package;
(b) in the case of the Licensee, only supply or grant any right to use CAL 1 Licensee Schema or CAL 1 Licensee Software, whether as a bureau, outsourced or managed service or otherwise, to an Other CAL 1 Licensee;
(c) not grant or allow any sub-licence of or other rights to use or access all or any part of the CAL 1 Standards Package, including through the operation of a bureau or other outsourced or managed service, to any person or entity who is not an Other CAL 1 Licensee;
The Licensee must. (a) maintain all licenses and registrations required for the use of the Vessel;
(b) observe all law and direction from the manager in relation to navigation of the Vessel and otherwise operate the Vessel in a manner which does not endanger or inconvenience other users of the marina; and
(c) at its cost, observe and adhere to any requirements of the manager and all law, Australian standards and engineering ratings affecting the marina and berth.
The Licensee must. (a) not in any manner describe itself or hold itself out as an agent of NLNL;
(b) ensure that NLNL cannot be or become liable whatsoever in respect of the provision of the Services or any other transactions entered into by the Licensee with any other party; or
(c) not grant or purport to grant any right, licence or authority to use the Intellectual Property to any third party whether at common law or otherwise.
The Licensee must. (a) only use the Products for the Approved Purpose;
(b) abide by any licence terms and conditions attached to any Dataset if provided as part of the Product;
(c) ensure that the only Products or part thereof which are downloaded, stored or saved by Users is necessary for the Approved Purpose and will be deleted, expunged and removed from the Licensees system upon termination;
(d) ensure that, other than as provided in clause 3.2(c), Users do not download any Products with the intention of saving to a computer or other system; and
(e) ensure that any information required to access SLIP or the Products (such as login IDs and passwords) will not be disclosed to anyone other than the Users.
The Licensee must. (a) prepare and maintain an internal switching manual in accordance with the regulations; and
(b) comply with any other requirements relating to switching prescribed in the regulations
17.1 This licence may only be varied in accordance with section 27 of the Act.
The Licensee must. (a) keep the Licence Area clean and tidy;
(b) keep the Licence Area, including all fixtures and fittings in it and the drains, sewers, conduits, flues, risers, gutters, gullies, channels, ducts, shafts, watercourses, pipes, cables, wires and mains (“Conducting Media”) in and serving the Licence Area, in good and tenantable repair and condition (except for fair wear and tear); and
(c) immediately make good, to the satisfaction of the Licensor, any damage caused to the Licence Area (including the Licensor’s fixtures and fittings in it) or any other part of the Centre by the Licensee, its employees, agents, independent contractors or any person on the Licence Area for any period expressly or by implication with the Licensee’s authority (“Permitted Occupier”).
The Licensee must a) pay the District a fee of $ as consideration for this Licence; and
b) reimburse the District for all direct costs incurred by the District for the use of District services in connection with their use under this Licence.
The Licensee must. (i) notify all persons who may access the Software under clause 4.1(a) of the terms relating to permitted use under this clause 4;
(ii) confirm their understanding and acceptance of those terms; and
(iii) take reasonable steps to regularly monitor use of the Software by users to ensure compliance with those terms.
The Licensee must. 5.2.1 issue a certificate containing the information referred to in condition 5.2.2 to each candidate which completes the requirements for a Qualification, in addition to any certificate or record issued to a candidate in respect of attainment of any constituent part or parts of the Qualification;
5.2.2 the information referred to in condition 5.2.1 is:
5.2.2.1 the SQA Accreditation logo for awarding bodies;
5.2.2.2 a reference to SQA as the accrediting body via its accreditation function which operates as SQA Accreditation
5.2.2.3 the title of the Qualification;
5.2.2.4 the name of the Licensee as the awarding body; and
5.2.2.5 the date of issue;
5.2.3 ensure that the form and style of the certificates to be issued pursuant to condition 5.2.1 are agreed in writing with SQA;
5.2.4 not issue any certificate bearing reference to SQA following the withdrawal or termination of this Licence (other than to candidates who have completed the requirements for the Qualification prior to the date of such withdrawal or termination); and
5.2.5 not issue any certificate bearing reference to SQA other than to a candidate who has completed the requirements for a Qualification.
The Licensee must i. ensure that each End User complies with the End User terms contained in section 7(a) above; and
ii. notify the Licensor immediately upon becoming aware of any breach of those terms by an End User and use all available means to prevent the continuance of the breach.
