No Other Promises or Warranties. USER understands that no promises are made otherwise than what is contained in this Agreement, that no warranties have been made that the FACILITY will be adequate for USER’S planned use, and that USER accepts the FACILITY in an “AS IS” condition. USER has inspected the FACILITY to be used and has independently determined that it is suitable and safe for their particular purpose.
No Other Promises or Warranties. Other than the obligations specifically stated in this Agreement, JHU makes no promises, express or implied, regarding the TECHNOLOGY. LICENSEE agrees that no representation or statement by any JHU employee shall be deemed to be a statement or representation by JHU, and that LICENSEE was not induced to enter this Agreement based upon any statement or representation of JHU, or any employee of JHU. JHU is not responsible for any publications, experiments or results reported by any JHU employee, now or in the future, including any of the INVENTORS and it is the sole responsibility of LICENSEE to evaluate the TECHNOLOGY and the accuracy of any data or results.
No Other Promises or Warranties. EXCEPT AS OTHERWISE EXPRESSLY SET FORTH HEREIN, NEITHER PARTY MAKES ANY REPRESENTATION OR EXTENDS ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE OTHER PARTY: RECURSION IN PARTICULAR HEREBY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE OR, EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. BAYER HEREBY DISCLAIMS IN PARTICULAR ANY REPRESENTATION OR WARRANTY THAT THE DEVELOPMENT, COMMERCIALIZATION AND MANUFACTURE OF THE PRODUCT, OR THE OBTAINMENT OF MARKETING AUTHORIZATION OR PRICING APPROVAL IN ANY PARTICULAR COUNTRY, PURSUANT TO THIS AGREEMENT WILL BE SUCCESSFUL.

Licensee agrees that no representation or statement by any MPP or Pfizer employee shall be deemed to be a statement or representation by MPP or Pfizer and that Licensee was not induced to enter this Agreement based upon any statement or representation of MPP or Pfizer, or any employee of MPP or Pfizer. MPP and Pfizer are not responsible for any publications, experiments or results reported by any MPP or Pfizer employee, now or in the future, and it is the sole responsibility of Licensee to evaluate the Licensed IP and the accuracy of any data or results.

MPP agrees that no representation or statement by any Pfizer employee shall be deemed to be a statement or representation by Pfizer, and that MPP was not induced to enter this Agreement based upon any statement or representation of Pfizer, or any employee of Pfizer. Pfizer is not responsible for any publications, experiments or results reported by any Pfizer employee, now or in the future, and it is the sole responsibility of MPP to evaluate the Patent Right and the accuracy of any data or results.
